2 weeks running straight....hos?????

    Anyone who edits a log other than the driver it belongs to is committing felonies for fraud by falsify entries to that log.

    Could you post a link to the verification of that ?
    Errors happen with e-logs . A driver can hit the wrong key when making an entry or forget to make a duty staus change . Our e-logs have an "error in log " option and when we log out we opt to either note the logs are correct or contain errors . We e-mail safety explaing the error , they correct it then send us an e-mail notice

    I can't remember when the last time I had to have a 34 hour reset. All you have to do is watch your hours and recap. Now if you are running 600-700 miles everyday, then I imagine 34 hour resets will come into play.

    Recapping your hours is a simple deal, though. Doesn't take a genius to do it....heck, I do it. lol

    Rick...in the old paper logs, FMCSA (see link below), "all entries must be made by the driver, in his/her own handwriting" (paraphrased).. see "(2) about mid-page.

    This is a grey area...whether a 34 hour restart resets everything prior to the completion of the 34...technically yes it does, since the complete 70 has been brought back to Zero and beginning again. However, going back to the drive from Montana to Minnesota, when he went way beyond the available hours (computing estimated miles since we didn't have accurate start/stop locations), at the point he busted the 11, he was running illegal and by accepting the changes made by his company, he accepted responsibility, but that does not releive the company of complicity. In fact, should a (as one poster noted) fatality accident occur, or major injury/damage incident/accident requiring DOT/FMCSA investigation, even 3,4,or 6 months down the road, both agencies have the legal justification to research the drivers "driving history" to possibly show that this driver has a "complete disregard for HOS rules and regulations" and it will also show the carrier "took illegal, unauthorized, and unjustified means to allow the driver to operate in an unsafe and illegal condition".

    A driver is required to have in their possession today and the previous 7 days of logs, or the means to have the carrier fax to the location (if the driver is getting an inspection for example) for the officer/agent to examine and be satisfied the driver is in compliance with FMCSA HOS rules and regulations. Anything prior to 8 days previous, the driver does not have to prove what happened...However, since most states now "communicate" with each other....one state can use their computer to access scale and/or POE crossings, and back track the driver/vehicle to time and date of crossing.

    I am sure I can speak for all other experienced drivers on this thread; We highly recommend that he take a 34 reset after delivery in DE!

    As one poster noted...it is possible to drive continually through forever without taking a 34 as long as the driver maintains approximately 8.75 hours per day total on duty time. Follow my example from my first post; total up the hours for the previous 7 days, subtract that amount from 70, this tells you how many hours you have available on the 8th day to drive. At midnight, you do it again, and again, and again..........the hours (on duty total) from the 8th previous day drop off at midnight and are available to the driver on day 8 of work, as long as the driver does not go past the 11 or the 14 of the 24 hour period.

    Are you completely confused yet....many newbies get confused at first, but with some practice, it does get easier. E-logs were supposed to end this confusion, but when a company "whips the books"...a driver is left out to dry

    I thought about that...but just used basic "total time consumed" (Line 3 plus Line 4) as a basis. Plus, he is using E-Log so fuel stops could be only 6-8 minutes, hard to factor in that issue when "generalizing"!

    You could try driving in reverse for a day here and there...wouldn't that move everything backwards?:biggrin_25525:

    Yes, I am not a newbie....7 years experience in the transportation field (dispatcher, logs, customer service..etc..etc.) lol I am a newbie to the e-logs though, and I can tell you that he didn't drive 8.75 hours everyday. Like I said in my previous post that we made our drivers do a 34 hour reset if they had used up all 70, and if they were sitting over the weekend to deliver on Monday (regardless if they had used all 70).

    Luckily he only drove 2.5 hours today, and the load wasn't ready. He will pickup tomorrow at 7am, and has been trying to get home for quite some time now, so hopefully he can be home later this weekend to take 3 days off. I will show him the thread when he gets home so that he can understand. I appreciate everyone's comments because it really has been very helpful.

    sounds scary, i will try to use the same excuses that congressmen in charge of taxes use, when they are busted for not paying their taxes over a period of years and owe $10million dollars

    It was merely a lapse in judgement over a period of years

    questi9on 26 doesn't apply to personal conveyance.

    it applies to foreigners and using logs OUTSIDE of U.S. jursidiction. something to that effect.
