    you better brush up on the regs.

    all time spent and shippers and receivers are to be logged ON DUTY. not line 2

    Actually...I think you need to read (or reread) those regs.....and let me know where you think any reg requires such!

    Only when you are actively participating in the load/unload process do the regs even come close to requiring On Duty log time. However, company policies might dictate a different philosophy, but not FMCSA. But if you think so...post the reg and prove your case, not your interpretation of any reg, but the actual regulation.

    i know that Lewiston ME, outside of the Walmart DC, a few years back, DOT was citing drivers for putting "off duty" while at Walmart.

    I dont know, i'm just sayin

    it may be everyone has a different interpretation of off-duty, including DOT officers

    Thank you. Our company policy is you can't go off duty at a customer, but can go into sleeper berth. I'm waiting right now to get loaded, I was on line 4 for 15 minutes to check in and was talking to the guys about how I want to be loaded and where to put the product. Then crawled in my sleeper and wait for them to load me. That's sleeper for sure

    I remember that...but here is why it isn't any more. They can write all the tickets they want, until that one driver who knows the regs, is willing to take the time and effort to challenge a bogus ticket in a court of law. You don't need an attorney, especially for a simple thing as this....just understand that laws are printed in the English language, each word of this language has a definition, and vague, open ended regulations should always be challenged in court. Those LEO's have no more, if not less, training in the "interpretation" of the regulations than we do...and they have their own little coffee clutches like us, where they find cute little ways to get some revenue for their state, county, city....until they are challenged in court.

    Unless that LEO can prove, beyond a shadow of a doubt, that the driver was still responsible for the freight contained in his trailer, and that he/she maintains responsibility until all items for delivery/pick up are completed...that driver, once backed into the dock, has no more responsibility of the freight, unless the driver is required to do the load/unload...if the driver is sitting in his truck, sleeper or front seat, or driver's lounge at the facility, he has no direct contact or indirect responsibility to the process of the freight.

    This is where OOIDA, or any legal group should be available (this includes the company you drive for and their legal staff) to defend any and all drivers, when LEO is abusing their authority, or harassing the workers of this industry.

    i was with you until this part

    i had to hold my stomach from splitting

    these companies would prefer to throw their drivers under the bus, and back up over them, than to defend them. It is much easier to fire a driver and put a mark on his DAC than to have some cojones and actually stand up to DOT.

    If ATA would work for the "trucking industry" instead of the corporate fatcats, if OOIDA had more teeth, if drivers would unionize
