I Got Fired For Discussing My Hours Of Service

    They do have a 90 day probation. I agree with you, except for this issue. Would you want to be the one to get fired because you were following the laws. I chose to cover my butt, and tell them that there was an issue so that later on, I didn't get fired for breaking the law. I was just trying to cover my butt. The DM could have done things different. She could have waited a week and fired me for something else, but in fact she fired me for what they are calling "complaining" about my HOS. I didn't do anything wrong in this picture and the fact that drivers are turning against me, a driver, is crazy to me. If people only knew some of the laws... I guess they thought I didn't, yet here we are, talking about my whistleblower complaint because I do know it was wrong what they did.

    I have spoken with an attorney, many. I know I have a case. They fired me based on discrimination, that they are not allowed to do. Sorry you feel this way, but it is what it is. Fired for "complaining" about my HOS. That's discrimination.

    Finally someone that understands the law for what it is. Even if I don't win my case, for whatever reason, this is what I mean. Federal law is federal law. It wouldn't have mattered if I worked there for 1 day. We'll see what happens, at this point, it's about my job and about my rights... not so much about money, but I will say that I am getting ready to lose everything I have because this happened and I can't find another job. If I do win my case... I hope the judge awards damages. This is really hard to fight, not only mentally and emotionally, but it also consumes money and time.     Well when I was an OTR driver, things were different. I didn't have to ad an hour and 40 min commute on to my work day.

    Thanks for this. I have never had a problem with my logs other than when I worked for FedEx Ground and try to cut conners to find time near Christmas, when I really needed it. They flagged me right away and I was required to go over logging with our safety guy. With that being said, I have always taken pride in knowing that I am doing things correctly. I have never claimed to know everything and learn new things out here everyday. I just know that I do a pre and a post trip always. That's what I was taught. I'm always trying to do my best and try not do anything wrong out here in a world "driven" by mostly men. I just try to prove that I'm just as good of driver, and sometimes better. If that means me finding things wrong with my equipment so that I and others are safe, so be it. That's what I do.

    I hope no one takes your advice because you are very wrong in this. The proper pre trip is laid out in the regulations with what, exactly, to check and what must be checked.

    I'm willing to bet that 30%, hell let's go as high as 40% don't ever do a pre trip.

    Pre trip:

    Truck starts

    CB is on channel 19

    64 ounce bubba keg full of high fructose corn syrup and carbonated water next to chair

    Pee bottle is in a safe, yet reachable distance

    All lot lizards have left the cab

    All trash has been thrown on ground

    Pre trip complete

    No it is not discrimination. It is against Federal Law to fire an employee for something of this nature as has been posted previously. I urge you not to go down the discrimination road as this will not prevail as it is not.
