Off duty, driving Tractor ONLY home, DOT Reg??????

    What's so ludicrous about it is that they would have been legal if they'd parked the truck and rented a car to drive home. More time, stress and fatigue, along with higher risk of collision, injury and death - but yet legal.

    So, my company has their own rules about PC. They told us drivers that we can use it during our 34 reset. So, I did today. But as I started driving I though, wait a minute! I didn't pre-trip and will not do PTI because I am on a reset and not supposed to do any job related task.... But I should do one if I were not resetting... after all, the purposes of these inspections is safety, right? So, now I am confused...:biggrin_25526: I don't understand... Is it ok to use truck for personal conveyance during 34 without pre-trip and PTI? Sent email to log dept. for clarifications.

    ...and if you log the way you are supposed to on paper, that ambulance chasing lawyer isn't going to be any better off. If anything, the allowances a company might make in their e-log system to allow a driver to violate the HOS would be an indisputable admission of violating §395.3(a), §395.3(b) or both.

    There is no requirement in the regulations that a pre-trip inspection be performed or documented. The only requirement is that the driver be convinced that the equipment is safe to operate. Pre-trip inspections and reports are company policy, not federal regulation.

    They way I've seen drivers "log" on paper any lawyer worth his salt will be able to prove they are false. Elogs are not the enemy, they are just a different way of recording things. People that chose to violate will violate, people that choose to falsify will falsify, Elogs will not prevent you from doing what you are going to do, it just makes it more difficult to get away with it.

    I don't thinks so Rock. IMO you would need to log out and log back in on PC, commute home and start the 34 from there.

    Some drivers just don't know what they are doing...the result of not knowing the rules of the game they are playing, combined with the pathetic training they received, and the lack of understanding as to what all a 1-800-sue-a-trucker lawyer is going to have access to in order to verify the accuracy of the log book. In this day and age, logging it as you do it is going to prove beneficial more often than not...companies just don't pay drivers enough to justify falsifying your RODS on their behalf.

    So dispatch or a shipper held the driver up to long and instead of them getting punished or charging the shipper more money they instead fired the drivers?

    You ELOG guys can use your tools but leave us paper and pen guys alone as our tools are just fine. Drivers can fix paper logs just the same as Elog guys can fix their logs. And companies can still fix any log they see fit. Your tools are not the same tools as I like to use for my job. This isn't a one size fits all industry.

    not for nuttin, i cannot live my life on some political pingpong suits in washington want to play with my livelihood

    nor am i going to remain in a constant state of fear of collapsing bridges, falling meteors or blood-sucking lawyers
