I have 15 + years driving under my belt with NO accidents until Nov 2012. I was in SC south bound to ATL when a pickup pulling a trailer full of tires came over on me forcing me on the shoulder. He then proceeded to slow down and come over on the shoulder forcing me off the road. The angle of the bank made the 1,000 Lb. super sacks that where double stacked shift causing the trailer ONLY to roll on its side. The Company I was driving for let me go because somehow I was supposed to avoid being forced off the road or keep the freight from shifting. Now no one will talk to me after pulling my DMV any help, suggestions, or options I have to get back to work?

In a situation like that i would have just let him hit me. That way he is the one charged with failure to maintain control of his vehicle an you are not at fault.

Yeah, not much you could have done. The last thing you want to do is swerve and/or slam on your breaks because you'll end up losing control of the vehicle. I agree with the above poster. Personally, I would also have just let that truck hit me. If you can't safely merge, expect to get hit. I also want to add that your 19ish years of driving doesn't mean squat with that accident on your record. That 19ish years went to waste in a single accident. That being said, stay away from the bottom feeders and the mainstream carriers. Most will either tell you no and the others will tell you you need to start from scratch.
Find a small LTL outfit somewhere. I'm sure with your backround it won't be hard to find a local job. Also get a copy of your MVR and CSA reports. If that accident isn't in either, I wouldn't bother mentioning it.pattyj and Tonythetruckerdude Thank this. -

Short of abandoning a truck, the absolute worst thing you can do is cut your wheel and roll a truck. Being at fault in a fatal accident or even getting a DUI is not as bad as rolling a truck. Take the hit! You don't even consider leaving the road, ever. All the companies look at you and say, "This guy didn't learn this in 15 years? We sure as hell won't hire him.
somehow, you were supposed to avoid being forced off the road. How the heck did a pickup force a semi off the road without hitting the left steer head on and breaking a pitman arm or ball joint without a head on collision? You steered it and the trailer flipped over. You are 100% at fault. Next time, take the hit.RickG and starsonwindow Thank this. -

i know a driver that got a DUI in his personal vehicle. It cost him a but load of money for a DUI lawyer, but he's driving.
ive known a couple drivers involved in fatal accidents, one killed two people. He got canned from his company but hired back after a year.
i had a friend that cut his wheel to avoid an elk. He can't get a job driving a Port A John truck in Michigan. No one will hire him. Not the mobile home movers, not the b trains. He went from hero to negative zero by simply cutting his wheel. The only person I've known to still not be able to get a job was this driver that drove for coca cola. He abandoned the truck and left everything unlocked. He still can't get a driving and that was 20 years ago. Apparently, Coke has M A J O R pull. -
You might find a small O/O that will take you on. The other driver at my company is here because he rolled an OS load on a ramp.

I had a not preventable rollover in 11/07. I was out injured till about may 08 when I was hired by Arrow flat bed. Drove the phoenix regional fleet with them till started seeing the company had issues with finances. Jumped to JB hunt in july 2009 where I went on the 6 western for about a month and then to something closer. Im now running intermodal during the day mon-fri out of San Bernardino for the past couple years.
Dont give up.... Keep your head up, get any accident reports that you can get. Even look into that company which was hauling those tires. Get anything that is favorable to you and use it to your advantage.
