Had a situation in Nebraska the other day. I was involved in a pileup, in icy road conditions due to an equipment failure. Pumping the brakes, trying to stop the truck - both tractor and trailer brake valves popped out due to an air leak. This caused the truck to go into a skid, and caused damage to several cars. After reviewing this incident from the company, I was told I'd be placed on one year probation. I was seated on a new truck and spent several hours moving in. The day after, as I was set to leave under load, I was called into the office and told I was terminated "You knew this was coming" Leaving me stuck 2,500 miles from home. Nebraska state patrol examined the scene and advised I was not at fault and I did NOT receive any citations or violations.. The company is going to charge me 260.00 for a bus ticket back to FL which is coming out of my next paycheck. I will be filing arbitration with Central Refrigerated Service, Inc due to entrapment, emotional distress, breach of contract and termination under false context. I am adding that my employment be reinstated or I will request my wages for the remainder of the year, as I am entitled. This is the 2nd truck I've had through Central that has had severe flaws. First unit I was assigned popped out of gear going down a 6% grade and almost killed me before I got it stopped. I had to hold the truck in gear the entire way back to the terminal, where I was assigned another truck. These trucks are deathtraps. I am lucky the accident did not cause harm to myself or others.

So did you hear the air leak during the pre trip did you see your air gauge pressure decreasing.and was your low air buzzer not working it is your responsibility to not drive an unsafe truck.I have had whole air lines blow off and was able to get off the road before my brakes locked up . Thank goodness they did not give you a.ticket you may still be able to find a job .

"Emotional distress" yea thats a good one !! ..how are you gonna prove they caused you "emotional distress" & what are the damages? Do yourself a favor and just move on, it will help you with your emotions ....

I'm thinking the people in the cars that were hit also had "emotional distress"........

I thinking this too. Timmie cut your losses and move on. They have a good reason for terminating you. Doubt you'll win this.

While the company may own the equipment... Ultimately the buck stops with the driver...if equipment is not safe to operate...then park it..No company can force you to operate unsafe equipment...
