This is agencies way of dealing with things. Especially the fmsca
they first try the tired old line "everyone pays the fine", Then they try and make their "created facts" fit the rules, then they lie and if you've made it this far
sometimes they go away. The system isn't designed for those who don't comply so imagine a mass nion compliance?
Or better yet imagine finding enough drivers with cajones to equal mass non compliance?

Update on original topic:
On this run from Fresno to Kent, WA...had the opportunity to stop in and check with CA scale (Cottonwood) and WA POE, (Ridgefield);
CA position on "personal conveyance" is exactly what Scalemaster has posted. Bobtail or unladen, short distance (no real definition on total distance, closest would be "local movement" for mall, restaurant). Anything under company direction/request would be logged time.
WA position is more strict. WA doe not recognize "unladen" as personal conveyance, you must be bobtail, the trailer is considered "part of freight", or "company movement". -
Whu would you even bother asking the police? Did they show you a law degree? Or do you just find it easier for them to dictate their version of the truth to you? Ask ten people you'll get 10 answers. Once you say you're off duty you're just that unless they can prove otherwise.

It's all based on how you look at things. Now there are those who think everyone should comply witout asking why or even if it's correct, legal, constitutional or based on any type of rational thought process.
So what you put forth? Is we should blindly follow the police cause they're the police?
Not down here we don't.

These "useless" rules you speak of have been necessary to maintain a certain amount of order...especially on the roadways. About a year ago, Montana tried opening up the highways with no speed limit, within 72 hours they had multiple fatal crashes...speed limits are necessary for fools that can't control their own behavior. As far as the FMCSA and other agencies that have placed rules and regulations on the industries, "we the people" have put the need in place....dispatchers using threats to intimidate drivers to run when not safe to run, drivers popping pills to continue running, alcohol issues, drug issues....the "outlaw" drivers with no regard for others around them have mandated the need for "limits and controls" on this industry, along with other industries.
So your "4 times" in court makes you an expert in all Federal rules and regulations? sorry....not buying it! -
I'll give you an example here: we had went to visit the family in Kenya a coupe years ago. Two thugs rob this mattatu passenger of money and his cell phone. The crowd caught one of them he cried [pleaded that it wasn't him to the angry crowd. Someone called the victims cell phone and it rang in the pocket of the captured one. There was a tire, petro and a match found this thug got a BBQ'ed head, Problem solved. teh police never investigated and the dead guy's family had to pay to get the body from the mourge. People can take care of themselves if goverenment willl get out of the way.cetanediesel Thanks this. -
