Im currently deployed to the Middle East and I drive in the US. Well my wife received a notice from NC DMV saying my CDL A had been suspended due to it expiring. I was told even though im deployed that they have to suspend it no fault of mine. I deployed to the Middle East in October and my card expired in Dec of 2012. So my question now is this a legit reason for suspension of my CDL?

In your situation they should reinstate you when you provide a new medical card . If they don't contact your state representative .
This issue should be addressed as it affects many veterans in the military but it would have to be done on a state by state basis . -
Here's some info for you. Starting back in Jan 30 of this year they now require you to submit a current DOT Medical Examiner's Certificate to obtain a "Certified" medical status as part of your driving record. You'll also be required to keep that record up dated if any changes occur. Fail to do so you'll become "not certified" and may lose your CDL. That's what it sounds like is happening to you.
For the military, however, there's some hope. It reads like this, the military is allow to renew before deployments. That's just one item to remember. It goes on to talk about reserve units. They will allow reserve components whose license expired during active duty outside the U.S. to be good for 60 days after the date of release from active duty. They need to submit a copy of their orders along with all the other paperwork when they get back to get the CDL renewed.
If I were you I'd write to the NC CDL people with a copy of your orders and explain what has happened. They just might let you fall under the reserve part of the new laws. Here's the reference (http://www.ncdot.gov/download/dmv/CDLMedCertGeneralInfo.pdf). Good luck and if you need anything else just ask and I'll do what I can.TheDude1969 Thanks this. -
Well no luck getting it reinstated til I return in mid-September at the earliest. Im not required by law to return to work up to 90 days after I return so I will be taking my full period of time off before I return to the civilian world. I could see them suspending my CDL if I flagrantly did not renew it, but I have I sent a copy of my deployment orders to them and they are not budging from that decision. Now Im very certain a CDL suspension will show up on my driving record at no fault of mine.

I'd still try to use that reservist clause and just go in there when you get home with deployment orders and ask for a renewal. If you can't you'll have to go through all the steps like when you first got the CDL. I do not believe it will show up on any record that your CDL was suspended. It's just a CDL that was voided because the state feels you lacked one part of the validation. I'll call your DMV tomorrow, if you like, and ask the people at the CDL section. Are you in fact a reservists? I don't know if you've had any experience sending paperwork to a state but sometimes you will not hear a thing for many months. I will not call unless you say it's ok.

if you deployed oct 2012 and it expired dec 2012, you could have renewed before you left. IF you didn't renew it ofcourse they are going to suspend you. They cant have a driver with no recent medical card driving around.

Whatever happens, I hope the best. Thank you for your service, and be careful.
