After 14 hours, can you drive a non-commercial vehicle for your company?

    Reread the rules. It's perfectly legal to work on line 4 over 14 hours. The rule states that you can't drive after 14 until you have 10 hours SB/Off Duty.

    Sorry but I worked for a company a bit ago that did this and the state came down hard on them for violating the OT rules.

    When you are driving, you are exempt from OT but as a dock worker, you have to be paid OT no matter what.

    On top of that, if you log as an interstate (11/14), your workday ends at 14 because loading and unloading trucks is on-duty work no matter what, not extra work. If you worked in the office after you worked in the truck, that's a different situation.

    The key is that you are still on the clock for that employer and even though your primary job is driver, they can't make you work beyond the legal limits of being a driver for dock work unless they claim you as a dock worker which means they lost that exemption. When they do that, they owe you back OT for everything over 40 hours form the time they started that stuff. Most states will have such a rule and enforce it, the DoL enforces the Fair Wages acts which explains job classifications and such.

    Driving a nonCMV is on duty not driving . There is no limit on how many hours you can work . The 14 limits how many hours you can work before you can't drive .
    There is no violation in the policy the OP described .

    I knew beer had a birth date . I didn't know trucks did . I wish Mexican born trucks were classified as illegals .

    Try reading regs before you throw in the wrong two coppers. First we never said you can drive over your 11.

    You say its illegal to work over 14 hours? Wrong. It's illegal to drive a cmv past the 14 hours mark. You can work as long as you want but cannot drive until you have 10 consecutive off duty hours.

    You say you can't drive a company car past 11 hours? Wrong. You cannot drive a cmv after 11. A non cmv ie allowed, and you log it on duty not driving.

    You may need to brush up on your 49 CFR 395 regs homie

    That's a whole other ballpark. But he said he was hourly so we just assume he gets his proper OT pay. He just wanted to know if it was legal to drive a non cmv after the hours rules :p :)
