Had a wreck, needing advice on what to do now.

    Wrong. It is a companies call to decide preventable or non preventable. All the DOT cares about is who or what is at fault.

    Try applying at some companies and see what happens and if that does not get you hired then you might have to go the route that Chinatown stated. It wont be the end of the world. As stated a lot of people have sent pm's saying thank you for helping them out. Or try a small company in your area. I don't know how long it takes for a company to put this on your DAC but the longer you go without driving the harder it is to get a job.

    The company can decide what they want to put on your DAC, but that doesn't make it accurate. Trucking companies do not have the authority to determine whether an accident is preventable for legal purposes, such as court cases. Only a certified LEO and/or accident investigator can make an OFFICIAL ruling.

    They may decide to label it preventable and fire you, but they cannot make that call for any official record, such as an accident report. They can put it on your DAC, because no one verifies that, but that can easily be removed if the accident was ruled non-preventable by a LEO.

    Even if the other driver receives a ticket, and is at fault.

    You can still be charged with a preventable.

    This takes place at the company level.

    We are not talking court cases here. We are replying to the original question by the O.P.

    Still can't believe y'all worry about this dac junk. It means nothing. These companies don't determine who's at fault. All they are supposed to do is verify the work history and they can say if they would rehire the driver. Anything else is too risky. They could get into lots of trouble giving too much info. I doubt they would risk it over us dumb dumb truckers

    I have a family too... That is how I look at it.. Everytime I turn the key and push the starter button.. I tell myself mentally... Hey ####### get back here in one piece with air in your lungs and blood in your veins.. Screw those people.. I can't live with my family if I kill myself to avoid them.

    You are wrong... company/insurance company decide preventability.. DoT decides whether you are at fault or not... You are getting 2 very important things confused... all the cop determines is who is at fault.. The cop could give a crap less as to whether you could have prevented it that is the companies call..

    I know a gentleman that worked for brown and root back in the 90's... He received a preventable when he was sitting in a café eating lunch.. He was 5 mile off of his route with 8 other haliburton employee's (drivers) and someone hit his truck.. The insurance company said.. If he (they) didn't take this route (which was shorter) he wouldn't have been there and would not have gotten hit.. The cops were never called.. Yet he still got a preventable...Explain that if the cop determines preventability....

    I got stuck one time at a shipper you had to back in through a field only way in only way out... got stuck... right steer tire found a soft spot and sunk to the axle had to call a tow truck out.. I had that on my record as a preventable.. They said if I had taken another path to the dock I wouldn't have gotten in that situation.. I fought the company and with the shippers word I got it removed.. cops were not called... Explain?

    No one said anything about legal purposes. There's a difference between DAC and MVR reports. We are discussing DAC and not MVR.

    Carroll fulmer might hire you. BTW....four wheelers do this kind of crazy #### all the time. It's best to bully them out because once they get beside you or in front of you trucking companies will almost never side with the driver.
