Quallcomm & HOS

    i'm currently out on the road with a mentor for swift transportation. this morning, i stopped the truck about 11 miles short of destination because i only had 10 minutes of HOS driving time remaining...my mentor acted like i could of made it, as if him starting to drive 10 minutes sooner was the end of the world...but he began to tell me that nothing would happen if i got a HOS violation from Qualcomm, only if a cop pulled us over would something happen...i didn't want to take the chance so i refused to drive..is he lying? can you get a HOS violation alert on Qualcomm and nothing will happen?

    My guess something would happen. I am sure Swift would take notice of a HOS violation.

    Well I drove for Werner and they have elogs.There were many times I drove past my hrs,even an hr over and never got dinged for it.I think your mentor probably wanted a fresh set of hrs to start with after getting unloaded.

    You did the smart thing. No, the Qualcomm won't issue a ticket and fine, but lots of other things could have happened. Who knows what if anything the company safety dept. would do, especially being in your training phase. But if for some reason a LEO inspected your Qualcomm you could be in trouble. And the ultimate worst case is if you were a block away, out of hours, and a drunk runs a stop sign and hits you, you are at fault!

    Your safety department would know and they could possibly call you and complain. With my company if you violate more then 3 times a quarter you wont get your safety bonus. There's no boogie man that comes to get you in trouble. Your trainer is probably right that going over 1 or 2 mins nothing would have happened but at the end of the day its your hos and not his so you did the right thing. He could have logged himself in and finished the drive if he really cared so much as thats what my trainer did when I had a situation like yours.

    Lefteye im not saying chance it and drive past your hrs,you stuck to your guns and didn't give in to your mentor as it should be.Im just telling you what I did sometimes mainly due to the east coast traffic..Always play it smart and don't get into that predicament you're running down to the wire with hrs.You're suppose to start finding a safe haven an hr before your drive time is up.With customers always do the math first before accepting loads to make sure you have the legal hrs to make it there safetly with time to spare.

    i appreciate everyone's responses, im still new to this industry...i want to learn things the right way...this mentor hasn't made me feel confident in his guidance at all, but since i don't know much about the industry, i didn't know what is actually true or not...but i assumed something wouldn't be right if quallcomm did that, i mean its not just a fancy alert system..im actually at the team phase of the mentorship

    You did right in my view you could drive your log will violate you it will mark it for 8 days but if you would get a dot inspection you could get caught their also when dot inspects the logs at swift you could get caught their I think the fines run 2400 depends on servity its a felony in NY ... you did good don't brake rules

    Every company is different. With Arnold, the rules are the following:

    First time: Safety calls and warns you not to do it again.
    Second time: Safety documents the violation and it goes in your file.
    Third time: Dismissal.

    They take HOS seriously. I don't know how the new "nanny break" comes into play here, they never stated if it carries the same weight as the 11-14. But I'm planning on not finding out!

    This of course is all in addition to the DOT summarily executing you on the side of the highway for an HOS violation.

    a violation is a violation........when they happen swift will make you take a log class
    the more serious question is what kind of mentor gets you into that situation........two key things planning and time management
    you have to pay attention to these cuz if you go solo I see alot of sitting on the side of the road for you, and no company will tolerate that
    plan your trips accordingly
