You believed something that someone who works for the government told you? WHAT'S WRONG WITH YOU?!? :biggrin_2559:

As best I can understand it, it looks like that the drug crime is the only one that can be assigned probation that is in the Class X category. Every other crime in that category is very heinous, malicious, and serious. I guess Illinois figures that while drug crimes are serious, leniency can be given for that type of crime if the person otherwise has a clean record. Any of those other violent crimes would never have gotten off that easily.

Hey, at least he's in Illinois. Unless they changed it recently (and they might have), felons in Texas can't even get a drivers license.

I think the fact that he's on here asking for help is a positive. He could easily say "no one will hire me, now give me my unemployment check" (assuming he's on unemployment). The sad part is, he went to CDL school, busted his #####, and cannot get a job. Who told him to get a CDL? Had he come on the forum BEFORE he went to school I'm sure we would have collectively said "dude, don't waste your time"
Not saying he can't get a job, just gonna be next to impossible. I wish him the best of luck.

EEOC is suing Dollar General for obtaining pre-employment criminal background checks. Who saw that coming.

CDL schools should take note and worry they'll be sued for predatory practices.

Building Systems Transportation would give you a look. A smaller outfit that treats their driver pretty decent and you can make decent money (45k-50k). They have probably 150 trucks and are based out of London, OH. Extremely fair company. I drove for them right out of school and the only reason I left is I went local with Gordon Food Service. B.S.T has a flatbed and van division (I drove on the flatbed side). I have a buddy from driving school that has I believe a class X. He killed an individual with a weapon and served I believe 9 to 12 years for it. Hes been there for 2 years now and still loves it. Check them out. bsttrucking.com

Class X felony drug charges generally refer to possession with intent to manufacture or distribute drugs. It is not necessary for the state to prove that a defendant actually intended to traffic the drugs; intent is assumed based on the quantity of possession. Even someone with no prior drug convictions or charges may be charged with a class X felony based on the amount of drugs the person allegedly possessed.
It is a class X felony to possess 15 or more grams of heroin, fentanyl, cocaine, morphine, lysergic acid diethylamide (LSD) or any analog of these drugs. It is also a class X felony to possess 200 or more grams of most controlled substances, including but not limited to any substance containing peyote, a derivative of barbituric acid, amphetamine or any analog thereof. Additionally, possession of 30 grams or more of any substance containing pentazocine, methaqualone, phencyclidine (PCP), ketamine or any analog thereof is a class X felony.
    Mandatory Imprisonment
Upon conviction of a class X felony, the defendant will be sentenced to serve prison time for a minimum of six years. Class X felony sentences for many drugs range from imprisonment for:

    • Six to 30 years for possession of 15 to less than 100 grams
    • Nine to 40 years for possession of 100 to less than 400 grams
    • 12 to 50 years for possession of 400 to less than 900 grams
    • 15 to 60 years for possession of 900 or more grams
Even first-time offenders are not eligible for probation-only sentences and will serve prison time if convicted. Class X felonies also carry a fine up to $250,000. Another penalty of up to $500,000 or the street value of the drugs may be imposed in some cases.
Those who have been charged with a class X felony drug charge should speak with an experienced criminal defense lawyer to discuss what penalties they are likely to face if they plead guilty or are convicted of the specific crimes charged. In some cases, it may be possible to negotiate with the prosecutor to amend the charge to a lower offense, which is punishable by probation. Covicted Of Class X Felony on Record no Probation..

Truck driving might appeal to a drug dealer, which may be why you are having a difficult time finding work.

You claim to have never committed a crime before, but before what?
Before you got caught dealing the first time, or before you got caught dealing after quite some time?
If the latter, then you had committed crimes before that you were not caught in - and you just lied to us as well.

He was eligible for probation. It says it right here in Illinois statues:

    (720 ILCS 570/410) (from Ch. 56 1/2, par. 1410)
Sec. 410. (a) Whenever any person who has not previously been convicted of, or placed on probation or court supervision for any offense under this Act or any law of the United States or of any State relating to cannabis or controlled substances, pleads guilty to or is found guilty of possession of a controlled or counterfeit substance under subsection (c) of Section 402 or of unauthorized possession of prescription form under Section 406.2, the court, without entering a judgment and with the consent of such person, may sentence him to probation.
    (b) When a person is placed on probation, the court shall enter an order specifying a period of probation of 24 months and shall defer further proceedings in the case until the conclusion of the period or until the filing of a petition alleging violation of a term or condition of probation.

Any other crime under that category would've been mandatory jail time. In this case it wasn't. Simple as that. Instead of trying to prove that he is lying, which there is no way to do anyway, either offer some constructive advice or stop responding to this thread. He's asking for help, which is what these forums are supposed to be for. It's really sad that a lot of people have forgotten that.

I don't believe the OP ever responded? And all of you are assuming he was convicted of a drug violation.?

The class X designation includes child molestation.. Harm committed against another with a firearm..

The X represents the most heinous of crimes.

Fine, we have all made mistakes, but NOT those kind of mistakes! This industry has such a black eye..Where did it start?

Speeding tickets? Over hours? Over weight? Then drugs, alcohol? Then smuggling, drugs, people? Now we tolerate and welcome child molesters? Armed robbers? Home invasion?

These are ALL the things we worry about while we're away from our homes and families! So the message we choose to send is..

Do the crime, hey, it wasn't my family.. And join my industry, we are quick to forgive and forget..

Until that cute little boy or girl turns up missing at a truck stop, or your cb and GPS is missing because you forgot to lock your truck.

I am all about forgiveness, but just like respect.. It is something that is earned, not given.

I don't believe a recent release has earned anything other than time served..and the trucking industry is not a dumping ground for ex cons.

I said my piece, I wish you the best (far away from my family) maybe one of the liberal bleeding hearts will offer you a place to stay with there family while they are out on the road.

    Luck

Jeeze Jaguar, before jumping to conclusions, go back and read through the thread. He did respond, and his response should be read before you go off the deep end.

jaguar, do you read before you insult people and go off ranting. Try reading. The op responded several times, he was convicted of posseion of a controlled substance with intent to distribute and got probation. He even posted the exact wording of the law that he was able to get probation. Its called reading comprehension, try it
