    I wasn't necessarily saying that these drivers should have to pay the carrier to train them, but it is part of the cost to the company and could be considered part of their compensation. It is much less costly to train someone in a factory than in an 18 wheeler. Thousands of drivers pay for their own training. Some elect to go to a carrier for their training and to be paid a flat rate for their time. If you make an agreement, you should be willing to live with the terms that you agreed to when you signed the contract.

    I have hired hourly employees and paid them the agreed rate during training, too. I have also hire and trained salesmen. Those are usually paid commission. A good salesman would not want to take a paycut with minimum wage.

    The trucking industry is the only one that I know of that people do their job for free or little pay.

    Feel free to correct me. However, there is people working in factories with CNC machines that cost more that a cheap truck. Should they pay for that training. You hire me you should provide the tools needed learn to do that job!!!!:biggrin_25513:

    In no job have I ever seen the cost of training to be considered as such.

    Thank you Justin. We can see from the Werner case that the payoff is paltry so your effort is close to pro bono publico and appreciated by me anyway.

    I was abused by this law some years back in a pvt. fleet and I've been told "you don't get that because your a driver" many times also. Success here will spread like wildfire and likely modify the behavior of mundane carrier management.

    Carriers have abused drivers for years, especially local drivers because they are interstate carriers even if the particular driver never leaves the city. That's wrong.

    What carriers don't get or ignore is....trucking is a cost center ( product distribution ) . Ask any accountant. therefore there is no money for lavish pillars outside fancy offices like the one in Chattanooga , or the private gym for the execs. in the same location. No money to hire cute 20 year olds for the middle managers to chase around the office either and the list goes on. And there is certainly no money to support salaries for a board of directors, COO's and CFO's. Like a school district has a PHD at 6 digits....no money for that either. I was educated in a suburban district without a PHD heading the district and I did just fine.

    Uncle Sugar has that covered. In one of my former lives I supported a payroll system for a Fortune 500 company. The term is called "imputed earnings" and is applied to things like life insurance, etc. Some types of training is subject to imputed earnings too because of the benefit derived to the recipient. Just don't ask me to define it here. It is almost like "if the moon is full, on an odd Thursday, during the winter solstice between 3AM and 11PM then..." I guess you get the idea.

    Pretty easy to show with a truck company.

    The truck makes no money without a driver.

    I was talking tax law. It is a bizarre world unto itself. Just the nightmares of doing PA (parts of OH & KY) taxation with head taxes/occupational taxes and school taxes out of payroll will convince you that legislators are doing crack in the cloak rooms every chance they get. Stuff is never clear cut, just the way politicians want it to be.
