Its tough, believe me. I worked for Wal Mart longer than Ive been married. Its like going thru a divorce. I made many great friends there. Ive received dozens of calls from them all in disbelief of what happened. I told my wife I don't know how to do anything but move forward. We are not going to wallow in bitterness, regret and disappointment. So we move on. I will know tomorrow with certainty if the upper Mgmt. will reinstate me. I am not holding my breath. After much thought I truly believe that this punishment does not fit the crime. I knew the policy and made a very thoughtless mistake. Policy is policy.

It was undeniable. They had the records from the on board log book showing "Driving" and the phone records that showed the time the text was sent. No wiggle room here.

Time stamps on text messages are not always accurate due to network traffic, down cell towers, etc. The time stamp occurs when it is directed through the cell provider router, not the time it was sent from the phone. Occasionally these times can be off by several hours, especially in rural areas.

I never got to go before the Accident review committee as the termination happened first. The accident was a jackknife with an empty 53 trlr on a slick over pass and a gust of wind. Not uncommon in Wyo where I had a set run mon. - fri. 8 years to Casper loaded and empty back to Cheyenne to get groceries. Never had an accident or incident in 8 years of the most God awful weather one can drive in. This is a region I knew like the back of my hand. Micro bursts in Wyo are not uncommon. Don't know where you drive out of Tom but we have had several blow over and jackknife. Goes with the territory. No high wind restrictions were up the day of my accident. No adverse weather reports came over the qualcom. Just a crappy day at the office. Don't know how much of the rest of the story you want to here but I will tell all. As to the random phone checks I can only tell you what my regional has told me. THis is an ongoing conversation I have had with him as we wait to here if reinstatement is going to happen.

I know it's too late now what you should have never gave them the cell phone records. You just gave them the noose to hang you with.
