Long story short as possible ... hired onto a company driving for an owner op (previously o/o ourselves ). Hauled 8 loads and discovered we weren't being paid. Got home and asked when guy was going to pay us. Said he had not been paid yet.Checked w the company and he had been paid. They told us what each load paid, the fuel surcharge and what com checks were issued. Called guy back asked when we wpuld see a paycheck. He avoided answering the question. Told him no pay no driving the truck. He said fine give me the truck back. So we did. Can't legally hold truck for randsom anyways. He got truck back w in 2 hrs of the conversation. Tried getting the company to help us. They won't help and said its not their problem. Talked to a couple of lawyers but they won't touch our case w/o $. Rock and a hard place here! Later we find out the driver he hired after us he didn't pay them either only they got stranded on the west coast and had to thumb their way home.. So its not just is now trying to collect our pay. Is there help out there or... are all of us seriously screwed on ever seeing our pay...

Yikes, I think I would have wanted to see some type of payment along the way? How long did the 8 loads take? Why don't you publish the name of the outfit in here? There may be others that have not been paid!. That is not good, Do you reside in the same state where this guy is? If so call the Attorney General of that state they have guys there fresh out of Law School that will jump on an opportunity to get on this case! this is a labor issue! I wish you luck! Let us know how it turns out!.
KW Cajun, NavigatorWife and darkangelsdiary Thank this. -
I wouldn't pursue this any longer.Chalk it up as a bad exp and move on.If you decide to drive for another O/O,I suggest you do your homework first on the guy.I was going to drive for an O/O awhile back but asked his company about him, thier story and his did'nt match so I declined.

It was a month there abouts. Both my team driver and I didn't get paid. Know of one other driver that didnt as well. He says he's from same town even... but think he maybe hiding out of state. That's a good idea on the attorney general... didn't think about that. Pretty upset over it... but who wouldn't be? I don't understand how someone could do this. Whenever we've had employees, they were paid.

Geeze, what a dirtbag. And I'm sure it's not just you two he screwed over. Fella needs to be tied to your DOT bar & dragged.
I'm sure responses will follow, but might get more, if posted in the "Trucker Legal Advice" section.
How much are you out, $$-wise, in total?
I believe OOIDA may be able to refer you to legal advice or someone to contact.
I would also advise making a phone call to your Attorney Generals Office, and take it from there.darkangelsdiary and TruckinWithJosh Thank this. -
Running for a "small operator" can be very rewarding or very costly and disastrous. The experience is usually, one or the other, and rarely a blend of the two. It's a crap-shoot in today's trucking environment in such a scenario where anybody who can get a loan for a $165k worth of equipment thinks he can become a millionaire in a year and never drive a mile just by signing the note. It's ok to trust small companies you kind of know, but never trust one-horse operators you don't know intimately

Why did you wait untill 8 loads later?I would have wanted my money after the first load.
j3411, biggare1980 and FEELTHEWHEEL Thank this. -
Loads take a week to process. Then there was an error on load # issued (verified it was the brokers fault) Then a holiday which shut things down. So believed the delays were legit. The last 3 loads were us trying to get home and not have to thumb our way back. Never quit on a load or out.

Methinks you been drinkin too much Sioux City Suds to be that passive, as far as this ripoff rat.
Many cases it's impossible to know you're not going to be paid.
In fact, the chances are MUCH greater, if the OP takes your advice, cuz afterward how will the next driver/employee know how this dirtbag really is?
Sorry, we don't agree, not even close,,, I get ripped off for 8 loads & you can bet the house I'm not gonna walk away. -
So how much are you out if you don't mind me asking? It's very unfortunate what this scum bag did and I wish you luck getting paid.
