Example for snowwy. " we hauled 8 loads and never got paid". This is acceptable.
Now this is slander here, " we hauled 8 loads and never got paid, the owner used our money for his drug and hooker addiction. He also used some of it in Atlantic city casinos." -
Well I would think with his proven record of good advice and factual information on this forum we should all trust him for his legal advice.Hammer166, KW Cajun, windsmith and 1 other person Thank this. -
Good thing you added that last "yes noddie", MJ1657.
Otherwise you might be facing a defamation suit from, well,, you know. -
If you can't shell out money for an attorney to sue the guy you might consider filing a criminal complaint of some kind. In your state there should be an agency that could bring action against him. This could help prevent other drivers from falling into his trap. I had a situation about 12 years ago, gave a guy money to become a franchise, but he didn't come through with anything on his side of the bargain. Filed a criminal complaint and lo and behold he's doing 10-12 years for fraud, a lot of other "franchisees" also filed complaints. While we didn't see any of our money back, we made certain the guy didn't walk free and I'm sure prevented others from harm.
not4hire and darkangelsdiary Thank this. -
It's what makes civil litigation tricky, and a good lawyer will examine your case and then examine the guy you want to sue to see what kind of chance you have to collect on the judgment, should you get one. The other side responds by countersuing, they will then attempt to run up the costs, and will seek to settle out of court if they have a loser. It's why rich people are powerful, (cause they can crush you with litigation costs), and why poor people aren't, (can't afford a litigation atty).
It's why litigation atty's won't take something on contingency if there is a relatively small amount of money involved, (you have to be upwards of 250k in damages to have something to litigate) They will however be glad to take your money on a pay as you go basis, and you will spend 70k easy trying to recover the 8k or so that you're owed...
It sucks. But you do have other options, you have small claims court. Not sure about this but the State Atty General may take an interest in this scumbag who commits fraud.
You should have held onto the truck until you got paid.Last edited: Oct 29, 2013

I wonder if it's ever illegal to say something untrue or misleading about someone even if it's positive ?
btw, totally unrelated to the question above but I really appreciate all your thoughtful posts snowwy, thanks man ! -
Might want to check with the DOT, Office of the Inspector General. Never tried it myself, but might be worth it if not receiving any pay. Good Luck !
