    I wouldn't of said anything about the switch and played it off on his scales. ( I don't know what you are talking about? I have a scale ticket that says I'm legal) or (I turned my Jake off right before the scale. I must of hit the air dump switch). He would of reweighed you then and probably called the repairman. If it was a CatScale weigh ticket you could of got them behind you. But now that the switch is on the report, oh well.

    Like other said go to court and you'll get it knocked in half at least. I would hire a local Springfield traffic attorney. Google them last three words you'll find one.

    Well I will say when I had the triaxles if a driver got speeding ticket or overweight cause pusher was up he paid it. Only overweights I paid was if we loaded out of dirt pit or something with no scale. Quarries won't let you out the gate over gross. It may not be right but the air up and down axle is the drivers responsibility, just like speeding he has control over it. That is a heckuva fine I hate it and could see me doing it. But thats how I feel about it.

    I could see this having a good chance of being thrown out in the hands of a good lawyer given the circumstances, may cost you a few hundred dollars. We all make mistakes. I tipped the scales 22000# overweight years back on the NYS thruway hauling liquid asphalt. My overweight permit had expired. Got it knocked down to around a $300 fine.

    In my part of NC the DOT used to sit at a T intersection, hiding in a convenience store parking lot waiting for someone to lift their pusher after leaving the asphalt plant. If they saw daylight or the wheel stop turning you were nailed.

    Not sure how you didn't notice the axle wasn't down
    on my trailer if loaded and axle is up any and every time I brake the down axle will smoke when break is applied noticeable immediately
