I have a question on this subject. Since marijuana is now legal in a few states, and you could somehow prove that the ill effects were gone when you came on duty, how would it be different than drinking alcohol while on vacation? No laws were broken.

I don't smoke and never have, but I think this is something that will hit the courts big time, if it already hasn't.

I could be wrong but they are state laws, we go by federal laws. Pot is illegal by the feds laws!

You are right. We are under federal law. Not state. The companies and the DOT and the FMCSA have been clear on any drug use. That's not changing any time soon

I quit smoking weed 13 years ago to get my CDL. I miss it everyday, but I quit knowing that one failed test is a career ender. Be glad you did not get in an accident and fail that wiz quiz, because you would more then likely facing criminal charges in addition to kissing the career goodby. IMO, there is nothing wrong with burning one on Friday night, then going to work on Monday morning. Unfortunately, the DOT does not agree, that is why I don't do it. DOT has come out and said even if you're in a state where it is legal, even if you have a medical marijuana card, if you come up dirty they're gonna come down on you. Even if you ever get a driving job again, we will never be able to smoke. If you have ever noticed, not to many people are worried about truckers rights or how laws effect their professional and personal lives.

To the OP, you'll find almost no love on these forums from these guys. Best thing you can do is go through the SAP program and sit in purgatory for the next 4 or 5 years. I say this from experience. I did exactly as you and here I am. In march it'll have been 5 years and right now "Driver Solutions" is working to try and send me to training with C1's school and with a little more luck I can get on with USA Trucks when I'm done. As far as other stuff I've learned in the last couple weeks, TransAM will hire you after 4 years and PAM will after 5 years. I never went through the SAP program cause I was never told about it till last year. As far as buying you're own rig, GL but it's hard to say if insurance will cover ya, that's likely to be your choke point.

You are F***'d, it sucks. Sorry for your troubles

ps, weed is not legal till the Feds take it off schedule 1 list, PERIOD. This stuff the feds are doing is completely dependent on thier mood, and you know how easy that can change.
