70 hr. violation

    If a driver goes over his 70 hours of service, what must that driver do to correct this?

    You can not correct it. You must stop and wait till you pick up hrs

    Wait until you get hours back if it's over 3 hours (maybe 4 can't remember the new law) come audit time you will be receiving a $2500 ticket (this new law took place July 1, 2013)

    Not saying you have to, but I'd start a 34 hour reset immediately. If you get inspected and the DOT officer asks for your logs, he'll at least see that you took immediate corrective action because you'd be placed OOS for 34 hours if he busted you driving over that 70.

    Not saying you wouldn't get gigged for it, but sometimes it helps to show you recognized the problem and did what you could about it.

    Why would a DOT man make a driver take 34 if it only took 10 to get hours back?

    If it was a 70 hour violation a 10 hour break won't do anything. You either have to do a reset or wait until midnight to get hours back (assuming you have hours to get back on day 1.)

    Don't forget to annotate in your logbook the time and reason for the violation. DOT will be more willing to look past a violation as long as you recognized it and took corrective action.

    Right, so if a guy gets shut down at say 1600 by the DOT and picks up hours at midnight, no 34 is required. The above poster wrote this:
    As if he was saying a 34 is going to be forced on a driver no matter what.

    Why hang yourself? You just may get lucky and they won't notice, we've had that happen at my employer. I've had drivers bring in inspection reports with No Violations Found and their log clearly had a violation.

    If you are at a scale and a DOT officer tells you to park it for 34 and if you move the truck you will be arrested, you gonna move?

    Wrong. If the DOT busts you on a 70, you'll be placed OOS for a 34 hr reset. Call it punitive if you want, but that's how they handle it*.


    *At least, that's how it was explained to me by the former DOT officer that managed our fleet's safety.
