Anytime you are stopped, even for a verbal warning, you have been "ARRESTED". LEO's are required to document each and every encounter with the public. Some, like Ohio, are required to have "X number of encounters" every month! A record was made of this arrest, regardless of whether or not charges were filed.

You made my point perfectly!!! This "little misunderstanding" may have lifelong consequences for the OP. AND it is his time and MONEY that will wasted trying, probably unsuccessfully to clear his name!!!

Brother, I hope you fight this to the bitter end. Not just for the damage inflicted to you, or the fallout yet to come, but for every other POS company out there who seems to enjoy bending us drivers over the fuel tanks and having their carnal way with us, all the while we are expected to thank them for the privilege of letting them do it!!!

I'm still here for the moment. I will depart soon enough. Just quitting is not the best option for me at this time.

Clear his name of what, a record of arrest? Good luck with that.

As far as I can tell he'd didn't lose much if anything. His chained-up truck was stuck on ice, he wasn't going anywhere anyway, and he hadn't called a wrecker himself, and to the best of my knowledge weather delays do not typically result in detention pay, and detention compensation doesn't typically begin until after 24 hours.

You know if a driver make a mistake, they hang him out to dry.

I do not condone a lawsuit, but legal representation to correct the entire issue.

This was not a "mistake". A mistake is when a dispatcher sends you to the wrong pickup location, or tells you the wrong trailer number to get.

This is gross negligence resulting in an arrest that, despite what anyone else thinks, WILL be on the driver's record. No charges filed, but the arrest is still there. And I can guarantee you he would not be able to go into Canada as it stands right now. Maybe he never intends to, I don't know, but he can't do it right now. Also, with an arrest on his record, it's not going to matter if charges were filed or not, it WILL affect him getting another job.

There is NO WAY that with all of the electronic crap on trucks nowadays that SOMEONE at the company didn't know immediately when the driver picked up a trailer that had been reported stolen. Some lazy ####### decided not to worry about it, probably assuming the driver wouldn't get pulled over or stopped. Gross negligence.

Schneider knows every time I connect or disconnect from ANY trailer, and some of those are 8 - 10 years old. This is not new technology. Someone at the company screwed up, and there's a solid chance that the results will affect this driver for the rest of his career, assuming he still has one.

Your attitude is exactly why the industry is getting worse and will continue to do so. No one is willing to stand up for what is right anymore, we're all just supposed to "be a man and take it". Yeah, well you do whatever the hell you want, but I'd go after the company with every resource I had. This is all the result of some idiot not doing their job. We're expected to do our jobs and make no mistakes and we have the right to expect the same standards of the companies we work for as they expect from us. This double standard stuff is complete BS, and needs to stop.

Dubious, don't pay any attention to the naysayers here. You know as well as I do that if this situation happened to them, they'd be raising hell about it. They can claim otherwise, but it's easy to say that when they're not standing at a county jail completely naked with some stranger's hand up their ###.

Good luck in your fight, and I hope you're successful.

Trucker Dave you are wrong way wrong if you get stopped you are not arrested, if you get a citation (ticket) you are still not arrested. A moving violation unless a misdemeanor is more like a civil case only need a proponderence of evidence that you fave committed the traffic of fence ( more likely than not that it happened) not proof beyond reasonable dought like a criminal arrest. Every time a law officer stopps someone they don't make a report or a percent record. Example I stop someone and tell them they have a tail light not working all I have done is tell them and on the way they go. If I run their license still no record only that the license has been run. If someone is going to give advice I think it best they know what they are talking about before posting useless information.
