Do you condone violating the FMCSA rules?

    http://www.fmcsa.dot.gov/rules-regulations/administration/fmcsr/fmcsrruletext.aspx?reg=392.3

Been in the rules since 1970.

    392.3

No driver shall operate a commercial motor vehicle, and a motor carrier shall not require or permit a driver to operate a commercial motor vehicle, while the driver's ability or alertness is so impaired, or so likely to become impaired, through fatigue, illness, or any other cause, as to make it unsafe for him/her to begin or continue to operate the commercial motor vehicle. However, in a case of grave emergency where the hazard to occupants of the commercial motor vehicle or other users of the highway would be increased by compliance with this section, the driver may continue to operate the commercial motor vehicle to the nearest place at which that hazard is removed. [35 FR 7800, May 21, 1970, as amended at 60 FR 38746, July 28, 1995]

I had a really bad cold, could not breathe, and was loading myself with cold medicine. I told safety about it and they told me not a problem, load has to be delivered.

This was really an uncalled-for cheap shot. Nobody's suggesting that he should get off scot free.

But unfortunately, meat haulers do have to mostly run at night, and as one who has run night time linehaul before I can tell you that it isn't for everyone.

And some of the comments about the driver involved in this incident are NOT???

Frankly, I am ashamed that drivers are willing to be so quick to bust another driver's gonads for doing the right thing by trying to expose the dirty, underhanded tactics employed by almost every motor carrier!!!

Abe doesn't make it a habit to refuse loads so I would have cut him some slack. If you're tired you're tired.Dispatch found a swap right away and that's what they should have done at the beginning of the conversation. You heard the words dispatched used which was uncalled for.Sometimes in this industry you're body tells you I can't go any futher. He did the right thing. No load is worth kissing dispatches back side,no load at all.

No, it is not an uncalled for cheap shot. I don't know if you have a family but I do and I fear drivers who willfully run when fatigued which is illegal. I have hauled meat so don't get on here acting like I don't know what it is like. BUT I WILL NOT PUT OTHERS IN DANGER BECAUSE I AM SLEEPY. IT IS CALLED BEING PROFFESIONAL!
