To concur with Semi retired if he is a contract employee, he cannot be told to stay on the road nor can he be fired. The working relationship can be severed upon one or both parties choice. Downside is that your husband won't be able to draw unemployment from this employer either. Unless he owns or is leasing the truck, he is not financially responsible for the repairs or maintenance of the vehicle. However, the owner can supply him with money to cover minor repairs and any required maintenance that may occur while on the road (eg oil changes or tires) and if there is any money that comes out of your husband's pocket he must, by law, be reimbursed by the listed owner of the truck.

If I could, I would offer your husband a job but at the present time I am only leasing my authority and he would have to supply his own truck and trailer setup and I am a hotshot operation and run 26K and under GCVW.

That "Captain Of the Ship" quote is so not right. You only decide what time the "SHIP" leaves the port,and then the rest of the day your at the total mercy of traffic,slow drivers blocking the hammer lane,shipper/receivers with bad attitudes and even the wants and needs of your truck.You may say I'm going to park at so and so and then you get there no parking.LOL

I did not read all of the postings but just to point out that if a company requires a driver to do something the driver feels is unsafe then the driver goes to Federal Court and wins big dollar amounts. Your husband should sue and buy you a fur coat.
Do some research but being told to work unsafely is a golden ticket. -

It is my understanding, and I could be wrong, that all companies have to carry a $1,000,000 liability policy. That policy will pay out to a driver who is put in an unsafe environment and is fired for refusing. This is Not legal advice and should not be taken as such.

Tell the dispatcher to call me if they need a real driver to handle the load. I drive nonstop every day in every condition no excuses. I was raised from birth by a retired infantry soldier we dont make excuses.

Not sure I've ever heard that liability insurance for the driver that Wooly is talking about but that would be good to confirm. IMO he can fight the company, park the truck until safe, take a bunch of pictures, record conversations, pull into a scale house, call the tax people and all of that won't matter a hoot. All that will happen is he will get fired which will result in:
1) no money, which you obviously need of he wouldn't be working there in the first place and,
2) a tougher time finding another job.
My advice is for him to get that mirror back in place if at all possible and get on down the road as slow as he needs to if the roads are open AND FOR THE LOVE Of PETE GET ANOTHER JOB ASAP BEFORE HE LOSES THIS ONE.
There was as young driver that got his hood taken off at the TA in Dundalk last year. That fella went through about 10 rolls of duct tape but he got the headlights and signal lights back in place. He even bought a west coast mirror in the store and duct taped that sucker on there. It looked like he just left Bristol, TN.RedForeman Thanks this. -
If someone gets fired for refusing to work, that would be some sort of employment or contract issue. There isn't insurance coverage for that. Well, except for a legal plan. That's sort of like insurance LOL.
