expedited contract driver question

    I am thinking on accepting a expeditor contract driver position on a 60/40 split, I get the (60%) I pay for fuel. Who pays the truck ins? Its a small fleet owner with own authority and uses brokers. Thanks any help would be appreciated

    The owner should be paying for the insurance but this is all dependent on what is in the contract - which you should get before meeting with them to sign it.

    Do you own the truck?

    Are you just a driver?

    If so, you should be paid as an employee with payroll taxes, and workmens comp.

    Thanks ridgeline that's what I thought. I worked as a lease driver before but paid with a 1099 for mileage pay only. The owner covered everything.

    No I don't own the truck. I'd be a contract driver 60/40 split to a small fleet owner. I know being a company driver is the best route to go but they wont do that. Thanks for your reply

    Just so you know, there is no such thing. He owns the equipment, you drive the truck. If audited, you could be in trouble.

    How would I be in trouble? Doesn't this go on everyday in the trucking business?

    You are not self employed so if you file a return showing such the IRS can come in and change the return to show that to be incorrect. Then you are open to fines.

    Do a search on the forum under 1099. In addition, look on the IRS site for employee or contractor at this link

    Go pay a lawyer 100 bucks to read that contract and I'd bet you get his thoughts within first 2 lines he reads. Besides think about it.....60/40 of what??? You will NEVER know the truth of that figure. Just what they tell ya. If they are keg it and half decent which I very seriously doubt they are the would have 30 or so trucks and people like you working for them. Make sense? Go work for a real inc company that has work comp etcccc.
