from earlier in this thread, it was the start of his work week, had just come off home time..

not uncommon for a person to spend time with the family during the day, before reporting to work for the night shift. But that does not make it 24 hours.

Could be something as simple as the prosecutor seeing that the EOBR did not show any sleeper berth time the previous 24 hours.

I believe the prosecutor probably just charged him with violating the NJ statute prohibiting driving after being awake 24 hours, w/o any evidence, just in case.

I don't know how NJ criminal "rules of procedure" work, but they most probably allow dismissal of charges, but they may not permit adding charges after the complaint is filed, so a prosecutor might just charge a defendant in such a case with everything they might be guilty of, then later drop those that are not evident.

I find it frustrating to continue to read of that charge reported by the media as being contained in the "criminal complaint", but so far I have not seen one shred of any suggestion of evidence supporting it, nor any suggestion of any question of its validity or even the source.

    Moral: Don't rear-end anyone.

Yep. If personal credit/debit card transactions are subpenaed (and they will be) ... A transaction from Lowes for 10 bags of mulch 8 hours before going on duty driving, not so bad. A $95 transaction that occurred 5 hours before going on duty at Crystal's Kitty Cat Club might generate some real interest. Moral of the story is, if you're going to be stupid, pay with cash while you do it.
