    Correct finish the probation and never speak of it again it will be dead gone no record of a conviction. But one little slip and bye bye second chance.

    Uh, no it would not be illegal. It sounds to me like what he got is a deferred adjudication. That simply means that he entered a guilty plea, but before the judge accepts it he is put on probation for a certain amount of time, after which the charges are dropped. It's a common practice in courts of law all over the nation.

    I agree with you that it's going to be difficult to get an employer to hire him as a driver, but he says his current employer already knows about his case and is willing to make him a driver. If his employer goes to bat for him with the PO, they can probably get something worked out where he can leave the state just for work. I don't know if the judge presiding over his case would have to approve it, but I'm guessing he would.

    Since nobody wants to answer your question I will. Yes, you can still obtain a CDL permit. Yes it will help you move up the ranks in your current job! Good luck!

    I do not have any experience such as yours where the law is concerned, but I do want to give you some encouragement. :yes2557:

    The judge saw fit to give you another chance; you were given a "golden ticket" at redemption! Do good by that decision, only keep company with people who are a positive influence, who make good decisions, and who are supportive, learn form their behavior and adopt it. I wish you well and send good thoughts and positive energy in your general direction in hopes that you succeed and that you make the judge proud of his/her choosing to give you that "golden ticket"! :biggrin_25525:

    I forgot to mention as I am on vacation and my rugrats are running me everywhere. Yes you can get a job driving even crossing the state line as long as your probation officer agrees to it. My brother is a felon and he has a CDL. He crosses the state line and he just had to get it approved with his probation officer. Now as for him I think he has been in jail/prison several times and it all comes down to drugs and that is another story for another day. Some people do stupid things when they are young and dumb and then there's the people who just never learn and do not need to be behind the wheel of a tricycle ( such as my brother)

    Probation normally means your convicted. If its court supervision you can get it expunged afterwords. In Illinois you can get it sealed for some felonies after five years??? From conviction. Expunging no record of arrest or conviction.

    you can also be on what is known as retirement of the charges. similar to SIS. but the Judge gives you a chance to show that what you stand accused of is not on par with your normal pattern of behavior (i.e. you had a really bad night and its never happened before and not likely to happen again) and he delays your court proceedings for a set period of time...usually 6 months or a year...after that time is up if you didnt get into any more trouble then the charges against you are retired permanently and dismissdx. while not technically "probation" because you dont report to anyone to check in or get drug/alcohol screened...you still must adhere to the terms of good behavior.


    the other way you can be on probation and not have a conviction on yor record is if you took a deferreral (usually one allowed to a defendant if its a first offense and not of a violent nature like rape, murder or sexual assault in any fashion). basically you technically plead guilty and are placed on probation for x amount of time. stay clean and out of trouble, the arrest and conviction are expunged or reduced to a misdemeanor of an unrelated nature (disorderly conduct, resisting arrest, or disturbing the peace, something minor).

    Applications usually ask about convictions, and you have not been convicted.
    You can honestly answer NO to that question.

    If you are going for oilfield, and that conviction is for any kind of trafficking, then you're screwed. Trafficking will disqualify you for HazMat and TWIC, and that's where the money is at out here. You could probably find a job hauling sand or fresh water, but that's about it. Good luck.
