Logging off duty when in sleeper. Yes or no?

My buddy runs team with his girlfriend. DOT almost busted her for logging a weekend in the sleeper. They asked if she ever left. She said no. They asked about the bathroom. She said I have a porta pottie. They didn't believe her. Once they saw one in the truck they couldn't argue with her. The truth is what you say it is unless they have some evidence otherwise.

Anyway i did have more than one safety person tell me this at more than one company but honestly I can't find anything in writing about it but I figure it's not worth the hassle anyway.
In short it throws a red flag up and may cause a little closer inspection of your logs. Perhaps I just misinterpreted that as being a violation -
I'm still waiting for someone to cite the rule or regulation where it states that you can't log off duty while in the sleeper except when you are using the split berth provision. I've looked and I can't find it. Anyone?
