Part 395 has where this came from and why driver was charged and placed out of service.

Form & Manner violations are things like forgetting trailer on log. Things not flagged etc. Officer in this case did not feel like writing it up as a driver error.
He went for the real violation.

The guy is reporting to be the owner of at least 1 or more trucks and have a driver if he was more familiar with all of 395 wouldn't be here asking why his driver is in the problem he is in.

I'll say it again..ALL logbook errors are caused by the driver, All errors by the driver ARE violations..forget the date= violation ! Forget the truck/trl numbers= violation !! Read it slow, slower, slower even more..

10/4 but part 395 is 19 pages in my FMCSA pocketbook, I was thinking you had a more percise location of the rule

I used to think that every carrier needed to spend more time studying up on the regulations and keeping abreast to the pending changes. Then I realized the quickest way to improve as a carrier is for others to stay the same or worse while you make minor changes for large results. If everyone tried improving at once your CSA scores would stay relatively the same.

So, now, when "carriers" ask questions they oughta know I just watch the answers pour in. I have no skin in the game, but I'm fascinated to see how many don't know where to look for the information they require.
