Would this show up as a refusal on my reports?

    I would have told the lawyer, either get me off completely or you won't get paid a dime. He should have not even accepted a plea let alone let you plea guilty on something that wasn't driving related.

    So, you were pulled over, but you were actually parked and the officer suspected DUI, but you weren't and the DUI was dropped, but you plead to reckless driving (a very serious offence), but you were actually parked? Did I get that right?

    I can see how the term "pulled over" can imply that i was driving which is why i went into more detail. If you're in a car and you see flashing lights, it's kinda the term that comes to mind. And yes i am worried about my pre employment reports because, i don't know, i plan on applying for a job...??

    Do not proclaim, what you do not have?




    And you were asleep at the gas station, but got pulled over and had to take a breathalyzer?

    If you were asleep as you say, you would have woke up from the cops banging on your window. They would have seen/smelled/heard you if you were drunk.

    what really happened?

    I've had my cdl for 3 years and have spent the majority of that time driving for Werner and I'd be very happy to go back there but they won't rehire me if there's a refused drug test on my record. Sorry to not be literal and specific enough to only say "pulled over" and not waking up to a kid rookie cop banging on my window while i had the engine on and slightly impeding cars at a small rural gas station.

    Honestly falling asleep in a running vehicle is bad enough without the drugs. Be sure and answer the medical form sleep questions honestly.. Probably a sleep apnea test in your future
