Troubled Past

From what I know of Law in SC and most other states as I know it well as it was my first career. The only way to have a record sealed is when one is legally no longer a juvenile. The only other way to have something taken off or expunged requires the signature of the Governor. Even if other States are a little different a Criminal Domestic Violence charge isn't going away b/c after one is found guilty they are subject to certain federal regulations.

 

I live in NH and know two people first hand that got their records sealed so they could work. One was a truck driver with a recent DUI. The clerk of courts person is the one who will either allow or disallow you to see the judge. He or she is the one that takes care of probably 50% of the cases without them going in front of the judge.

 

Don't give up. You screwed up bad and you are going to have to pay the price. You may well end up paying more than you think is fair, right, just or whatever. But no one said life is fair. It is up to you get back on the right track. I will give you a star for recognizing what you did wrong and trying to do right. Good luck

 

Are you referring to strictly criminal offenses or traffic/civil included?

Civil are pretty easy. I was working construction when the bottom fell out. I wanted to get back into trucking but my record had some substantial dings in it. 2 suspended licenses due letting Child support fall behind and 2 recent (At the time) speeding tickets. $900 to an attorney friend of my wife (She if former LEO/detective,.. retired now and does PI consulting and still has connections), he petitioned the judge here in Fla. I never even had to show up in court. He let him know that due to hardship I need my record cleared in order to re-obtain my CDL and go to work. This was back when the unemployment here was reaching 18%. I caught a break and have kept my license clean since.

So it can be done.

South Carolina’s “implied consent” law says that if you are lawfully arrested by an officer who has probable cause to believe that you have been driving under the influence, then you consent to taking a chemical test of your blood or breath for the purpose of determining your blood alcohol content (BAC), and of your urine to check for drugs. The officer gets to choose which test you take and you cannot refuse these tests without penalty.

My record was for possesion of controlled substances the judge somehow play tricks and turn that charges into a misdemeanor, 8-10 years after i ask for my expungement it cost me 30$ and i had to wait 3 months and i did receive confirmation that my record was gone.

 

And now we have the a hole that wants to start throwing stones at someone trying to better his life. Not everyone can be as perfect as you mr brads6.9
Even getting your own authority could be an issue with insurance because of lack of experience. It may be easier to get in via the hotshot route. I have seen many others do this.

 

I don't judge anyone and sincerely believe in second chances but your past will haunt you. The best company to begin turning it around is Carolina Cargo out of Rock Hill, SC. Being brutally honest it's not a job anyone would take in trucking but beggers can't be choosers and sounds like you need to start where you can.
