The driver of the truck that backed over and killed a blind Austintown man filed a not guilty plea today to a charge of vehicular manslaughter.
Clement Davis, 63, of Warren, had been scheduled for arraignment at the Mahoning County Area Court here this afternoon for the misdemeanor charge, but that was cancelled due to the plea.
Davis' pre-trial hearing is set for 2:30 p.m. June 16 at the Mahoning County Area Court in Austintown.
Anthony Latosky, 29, of Austintown was killed May 30 when Davis accidentally hit him with his garbage truck as he backed out of a private driveway. When the accident occurred, Latosky was walking north on the east side of Raccoon Road.

One thing the paper has failed to mention is that this truck was equipped with backup cameras- which were broken and the company failed to get repaired. The truck was not equipped with backup sounds either, so the blind man never really stood a chance. The driver had been out and around the truck before backing out because he had emptied a container, so he wasnt backing up without looking either. Its a tragic accident and I was quite shocked the prosecutor chose to charge the driver.

Im not in the law's eyes there isnt a thing called a accident. Someone has to be at fault therefore so they can file lawsuites and prosecuter can get reelected therefore he needs votes and money from lawyers to fund getting reelected

You ever see one of those backup cameras? They point straight down, might have helped if it was in working order, but the only time I ever used them is when I was docking a straight truck because I could only get close, not rest against the dock. Of course I also honk twice to let people know I am coming, get out of my way; my truck has no back up beep on it unfortunately so you must make do with what you have.CassAnn Thanks this.

No I have never driven a truck with a camera, so your insight is much appreciated. I feel bad not only for the family and their loss, but also the truck driver.

I wonder if the deceased was deaf as well. Sorry, backup alarms are good in noisy places, but a residential area (or any place a blind person is likely to be unassisted) is quiet enough. Quiet enough that any person with normal hearing can easily detect an approaching vehicle. An approaching truck should be easily discernable...

You bring up a good point Lurch. Some of the info I read said the gentleman was accustomed to walking down that street by himself with a cane. I would think that would be harder to do if he was also deaf.
