yes and I do the same as mentioned. If I need two lanes I swing the tractor wide and leave the trailer to block traffic from squeesing in.

I had something similar to this happen back when I was P&D, although there was not 2 lanes to turn like here. I delivered to a strip mall and as I was pulling out onto a busy 2 lane road I did not see the 4 wheeler that pulled up beside me, half way in the grass. Of course when I had the opening I jumped for it, and did not see the car until I was about to hit it. When the cop asked her if she saw my turn signals and her answer was "yes, but I thought I could beat him", the cop had that "Here's your sign" look on his face, and gave her a ticket instead of a sign.

It certainly looks like one of the brain-fart moments we can have when trying to drive, and maintain other mental focus in a conversation over the phone.

It's both of their faults. If I were that guy's boss, I'd fire him, and pay for the damages to the car.
That being said, if it went to court, and I were on the jury, I'd be inclined to let them both handle their own damages. The car driver acted in a completely stupid manner by moving past another vehicle in a lane that was already occupied. I do that on my motorcycle, but I always have an out for myself, and if something happens I'll have to figure it's my own stupid fault.
BTW, unless that was California, there is a very good chance that the driver of the car could get a ticket for that maneuver. The same laws that ban motorcycles from lane splitting in most states also ban cars from passing another car in the same lane, even if the lane is wide enough to do so.Rick Brown Thanks this. -
Both were idiots, but the truck driver was the only one at fault. -
^^ Nope. The car was not moving. The truck was moving. The truck hit the car. Stupidity [of both] aside, the truck caused the damage. By your logic, all telephone poles that are knocked over are "at fault" because they occupied the same space the trailer tandems wanted occupy.

In the "other thread" about this video, I stated how I encounter a similar setup at least several times a week, at an off ramp on the way to the main company yard. I would take the left-hand lane of a 2 right turn lane regardless, allowing me more room to swing in my turn. But in my case, I haul dedicated OSOW heavy equipment, and am usually a minimum of 10' wide, sometimes up to 14'. Only when I am over 12' wide do I grab both turn lanes; anything under that, and I am perfectly able to make the turn without running into the lane beside me. I do this quite a bit during rush hour, where the four wheelers are steady clogging the lane on my right. My only point was if you don't take up BOTH lanes like you mean it, you can't fault a 4-wheeler for doing ignorant things.
You just have to make sure you don't get all ignorant as well, like this driver did.....
