I was parked on a truck stop and another driver hit me with the back of his trailer. The damage to my truck is pretty extensive, antifreeze all over the place, can't drive. The policeman came and recorded the accident. I got his license plate/license number, insurance company info. He is driving for Werner, I believe they insure themselves, the insurance company is ACE American Insurance Company. I called the insurance company, they are closed till Monday. Spent an hour on hold calling Werner, no luck, "agents are busy". This is my first accident, what do I do next? Should I pay for towing/repairs and file the claim with them to compensate me? I don't even know how much it is going to cost me, the front is completely messed up. Are they going to compensate for the load that will be delayed now since I am loosing time and money on it? What about the depreciation value of the truck? I was planning on selling it, but now when it will have an accident on a record the value will go down. Please, give me your advice if you had a situation like this.

I called them (I have progressive), they said we need to file a claim with at fault carrier first, and then if they don't handle it, we will have to call progressive

I would call progressive and have them tow it and let them handle it that's why you pay them. I think you have 24 or 36 hours to contact them its in your policy

I'm going to assume you told your company the whole story... I believe what they told you is a load of crap. What you should do is calmly and politely call them back (your ins.) And remind them that you pay a premium for them to work for you. You need assistance now, not Monday. There has to be a night and weekend number you can call for the other drivers insurance but progressive should be helping you.Straight Stacks and Sneakerfix Thank this. -

Personally, I'd have my truck towed to a shop I felt comfortable with doing the repairs ASAP...the sooner they get it, the sooner you will get it back. Tow bill gets submitted to Werner's insurance along with the repair bill. If you rent a truck to continue working, that also gets submitted, and will likely be easier to collect than if you take time off with plans to try collecting for the downtime (in which case they'll bend you over looking into exactly what your "net" would have been...because they aren't going to pay for the fuel you didn't use or the wear and tear on the truck when it wasn't on the road). If you have to spend any time in a motel, that too gets submitted for reimbursement.
They will probably take their sweet time paying on the claim, and the more wiggle room you give them to dispute any of the charges the longer it will take. Not much to dispute about truck rental, repair, or tow bills...all costs incurred as a direct result of the incident. Start getting into "Well, I usually make $XXXX.XX per week" and it becomes a matter of arguing over how much it would've cost you to make that money. This is where the quality of YOUR insurance company and the policy you have with them becomes important. Good insurance will pay the claim in order to get you back on the road, and then go after the other party to recover the cost of that claim. Take pictures of it before it's towed. Take pics of the spot your in and the surrounding area. May help later trying to explain how it happened
