My biggest concern is the downtime. If I spend a week living in the motel waiting for the truck to get fixed, not only I am loosing over $3000 in profit for the vehicles I have on my trailer already, but also a potential money I could make if the accident didn't happen. That is something I can't afford to loose, I have bills to pay and this truck is my only source of income. And if the diminished value is something more or less questionable, there is no questions that because of their driver I am forced to stop working because my equipment is damaged. Downtime is something I am 100% entitled to. I would gladly let them rent me a truck until mine gets fixed, but I doubt they will succeed. My trailer need to be paired with a truck that has electrical brakes connection, not every semi will work. Plus a trailer is on a smaller size so it would be hard to find a right substitute. -
Yup, I realize all that but like I say, it's not a law. Just like a medicare claim or workmens comp claim, they either just say no or ignore you. You can sue but that could take years and lots of YOUR money. Most cases never come to trial, the other party just puts you off, asks for a continuance and so on until your completely broke.
The insurance companies are only required to fix your truck, that's it. Anything above and beyond that would be extra coverage that you bought. I had that extra coverage until I put it to the test and just cancelled it. I was to be paid for loss of income. Then I find out it only kicks in after 10 days down and only pays $10 a day. Can you ##### believe that!!!!!!!!!!!! -

I think a lot of that depends on a company and since Werner insures themselves, I hope they will be more cooperative. Was looking online and found an agency that works for contingency fee (they take % out of settlement, no money down or if you don't win) to fight the company for downtime. If Werner refuses to work with me on that, I will go all the way. Its a huge company, so hopefully they won't fight for a few $$ and spare themselves some pain in the ##* -
Just another side note. If you would have dealt with Werner direct they probably would have rented you a car, hotel, and possibly some per diem a day.

They may be like Walmart. They just ignore you or say no and see you in court. You have to realize, they owe you nothing other then to pay for your truck to be repaired.
Look, I'm on your side and it sucks but be prepared. -
I was hit by swift and received everything I asked for including almost 400$ per day down time ......for a month and a half...
