The OP states that he does "towing, on call". That begs the question, is being at home, "on call" to be considered "work" and therefor on duty, or is it like a salary, and can be logged "off duty"? When called out, it's obviously "on duty". He wouldn't get a 34 hr reset, but he'd have recap hours -- maybe enough to squeak by.
Is "being on call" at home ON DUTY? I'd have a hard time arguing that it is, as you are relieved of all responsibilities for the vehicle and company.

We usually go off-duty during that time, even though we might be considered as in an 'on call' situation.
And with the current regulations, that is legal.
I would think it would only apply once he is actually called to duty in that job, and began preparations to get there. -
He said he's working 80 hrs per week or more. He's toast if/when he gets caught.

A doctor can work 80 or more hours a week.
An RN can work the weekend shift at a hospital, and have another job at another facility during the week, working 80 or more hours a week.
A CNA/hospital tech can work at a nursing home monday to friday 40 hours, then work at a hospital on the weekend and work 80 or more hours a week, and it's common.
These people hold peoples lives in their hands for their whole shifts. Yet they can work 80 hours a week, no problem. Yet another example of how trucking has been screwed over.Gearjammin' Penguin, Loose Leaf, MrEd and 1 other person Thank this. -

For the record I imagine your on a six day schedule limited to 60 hours not 70. Technically you may be violating FMCSA regulations with that 2nd job I say may be because you might be intrastate not interstate. What I recommend however is write a letter to your closest regional office of the FMCSA and simply ask them. Don't get into detail and use hypothetical questions only. You should get a reply within ten days.

Regardless of DOT regulations I wouldn't put them first in line to nail your butt to the wall.The people you need to worry about are lawyers.If you get into an accident in either position regardless of fault the lawyers will dig as deep as they have to to make this your fault.Thats when your screwed.Not only will you be sued for as much as possible then the DOT will step in and get you.
