I'm not saying your wrong, you have the proof right there in writing. And I may be wrong exiting the route to get a repair or something like that. Is that considered unprofessional? If it is then I'm still going to take my unprofessional self off the highway if that's the safer choice.
Our permit person sits on the AASHTO council and I'll happily take her to court with me if and when that time ever comes. I've been at this for 27 years and so far I've had 1 citation my entire career and that was for a spare tire that wasn't secured in the rack. I'll take my chances with a judge if and/or when that time comes. I'm not advocating deviating from the permit just for the sake of flipping the bird to the state but as I stated in my earlier comment, if I need a tire fixed and my choices are sitting on the side of the road endangering lives or pulling into a repair facility and risking a BS ticket from an over zealous Barney Fife, let Barney start writing.

Catalina, I agree with your sentiment. If we don't take this BS stuff to court and try to get a judge Who understand reasonability and common sense, and we just continue to pay these BS tickets, it may never get rectified.skootertrashr6 and catalinaflyer Thank this. -
Ok let's step back take a breath and try this again. I am not arguing, there is a difference between discussing and arguing there is NO reason reasonable people with different opinions can't have a civil discussion. The title of the thread is "permitted load stopping at truck stops" I have hauled heavy loads in Ohio for years I know the system I know the permit people I know the gimmicks. Here it the FACT as it stands on 11/20/2015 you cannot deviate from you route with a permit unless it's specified on your permit period. I don't care what some council says or a permit girl or what they "plan" on doing. I care what the head of the agency in charge says and he says no. @catalinaflyer with all do respect I think you can be a little thin skinned at time and a statement like "still going to take my unprofessional self off the highway" is childish and brings nothing to the table. Then you changed the subject on me in an attempt to buttress your point. I NEVER said anything about getting off to get a tire fixed or anything the subject was getting off at truck stops and you can't. It's also illegal to speed but I do it fairly often, if I get a speeding ticket and try to fight it by saying my permit girl said it was ok because she's on a "council" it won't fly just like the permit violation. I can tell you the three places in Ohio you have the best chance of getting a ticket for that are ( Madison county, Licking county, and Lodi for the record) I routinely get off permit to weigh or grab a sandwich, I'm just aware of where I do it and if a Barney Fife wants to write me a ticket I'll know he's got me dead to rights. I never called anyone unprofessional I simply pointed out that it comes up on here a lot and part of that is knowing the rules for what they actually are, not what you've been told. Would anyone run an overweight load because "dispatch" said it would be ok? I think not but your risking your record for that very reason. I don't care if you do because I do it, but there are people in here that might actually be trying to learn and you are giving them FALSE information. Anybody who thinks in wrong I posted Mikes contact info earlier and his email is on Odots website fell free to check. But when you get busted telling the judge "some guy on the internet said his permit girl said its alright" will not win the case. I look forward to a reasonable civil discussion.

As for using the "our permit girl" line, well if our permit girl was in fact just that, a permit girl I would not go by anything she says however she holds a seat on the AASHTO council and has for several years. I'm not advocating anyone deviate from their permit based on something I said or something she said. I admitted I was wrong on the subject and as someone else pointed out Indiana did add that provision to their permits at the same time Ohio agreed to this provision. But Ohio has agreed to many changes at these conferences however they have changed absolutely nothing since 2008. Indiana agreed to the same change and it was done the first day of the next month.
So moving forward, Ohio says you cannot leave the route, we've established that so if someone is trying to learn from this then what they need to take away from it is they will need to figure out where they want to stop and have that added to the permit. Myself personally if I ever find myself in Ohio again under permit and need to stop for a legitimate reason, I will go off permit and stop. If I receive a citation for it then at that time I'll take it to court along with the council member from AASHTO who by the way is also very well acquainted with Mike and they can discuss the discussion they had at the conference regarding this matter in front of the judge. If I get stuck with the fine then at that time I'll either stop going through Ohio or have multiple stops added to my permit to cover me if I need to stop.
It's an extremely antiquated law on the part of Ohio, the other states who used to have this law in place have either done away with them all together (takes an act of congress) or added a provision allowing this. Ohio has sat on the same provisions for almost 8 years even though trucking, regulations, hours of service etc. have changed drastically in that same time frame. -
Actually Ohio has changed several things, adding the 4th axle on the trailer was December 2011, regional heavy haul provision was last summer, crane provision was in 2010 I think. So they have changed some things. As far as your "permit girl" those were your words not mine, and I'll stand by my statement that her seat on any board is irrelevant, if she knows Mike have give him a call and get to the bottom of it. As far as my " professional" statement it was about this group as a whole not you specifically, you added the take myself off the road nonsense which came off as petty and childish. I'm glad you've only had one ticket I've had many I've a graduate of the school of hard knocks. But I know my business and I know my state and I don't have to be on any board to know it. I do have a question I thought you were a pilot among other things in your younger days, then you say you've drove for 27 years yet you don't look that old, are you older than you look?

My career path was to take over when he retired however the old man who owned the company passed away and within 3 years his fighting children ran the company into the ground. In the mean time I took a local job to supplement my part time aviation income hauling fat cattle into what used to be the Monfort plant. I got that job because my mother was the operations manager for Garden City Kenworth (which no longer exists) and her connections with the owners of what was then TransLease (now Booker Trans). So my avenue to a career as a pilot fell apart, I didn't have enough fixed wing turbine time to get on with a regional airline and I was making decent money in trucking so here I am still in trucking. I tried for many years to get a seat with an aerial ambulance company but they really only hire former military helicopter pilots. The occasional civilian trained pilot who gets a seat just happens to be in the right place at the right time. I was never in the right place unless I wanted to move to Papua New Guinea or Saudi Arabia.
I stopped driving for several months when I got a job flying aerial ag (crop duster) but quickly realized three things, 1 these guys don't live long, 2 I don't have the balls for that type of flying and 3 they don't make $#!T for what they do. I moved back to Wichita to start doing some pilot instruction to build more hours but within months I was broke and starving. I answered an ad in the Wichita Eagle looking for a driver and wound up going to work for a 5 truck carrier there hauling Boeing aircraft parts between the Wichita factory and the Puget Sound area and since then I have been either a driver or in operations but always in trucking. -
I trucked oversize loads through Ohio from 1994 to 2001 you are allowed to stop at truck stops and rest areas with no problem. You have curfews and need restrooms as well as food & fuel in that state as well as any other. NO state can restrict your access to any of those, they have to make reasonable accommodation for oversize loads to access to these services.
