    They cannot require you to take a drug test when you are off duty. it has to be just before going on, during or just after getting off. Get a lawyer!

    Then, if you want to drive, either find another lawyer or pony up some bucks...

    If they are in the wrong they might have to pay legal expenses and even if they are not required to do so, investing a couple bucks to save your preferred method of income generation seems, to me, to be a no brainier.

    If you have been wronged and want to work, invest some money... If not, good luck in your next career... or start the process outlined above to do what's required to get back to work in the event of a positive or refusal.

    You still have options.

    Nice try, alcohol testing and random drug testing are different.
    I have never read anything that states when a random drug test can occur.
    And nobody has ever provided a specific rule.
    The alcohol test only counts when a driver is performing safety sensitive stuff, or right before or after

    Hire right only keeps drug testing 3 years. There are tons of companies that don't use Hire right. When I was a foreman at my last company I was instructed to have the driver come in and do not tell him its a drug test. He comes in office I give him the notice face to face and he has 1 hour to report to lab.

    Omg, thats effed up. I just did an application with these people. Do they do follicle testing for preemployment screen? How long had you been working for them before they pulled this stunt?

    The FMCSA publishes a handbook cocerning the "hows and whys" of drug testing. Essentially a Safety Sensitive Employee (CDL holder) has to be randomnly selected for testing. That said, you must proceed "IMEMDIATELY" to a DOT approved testing site to provide a sample. Anything less is considered a refusal and is treated as a positve screen. The regulation makes no distinction for on-duty or off, just random selection.
    Take the test first, regardless, then challenge the randomness of the selection process conducted by the employer.
