Service Failures...

    Bill Clinton had a service failure. He went on to serve as President of the United States. I'm not sure, but it seems as though, they are a good thing. You may wanna check to be sure.

    I want to add something here about DAC, FMCSA RULE 383.35 and The rules about your old company releasing information on you. I have read maybe a hundred posts in these forums and other forums where people are leaving the impression you can hide behind these disclosers rules. YOU CAN NOT. If you are listed as a do not rehire there is no company out there that's not going to want to know why! Its true the old company can not and will not release this information but that does not in any way prevent the new company from asking YOU for the reasons and you are REQUIRED BY 383.35 TO GIVE THEM THIS INFORMATION. Also I have found that most of the mega carriers have people in them that know people in the other companies. One of the safety guys at my company knew a guy at JB hunt. I remember him telling me about asking his friend at JB Hunt about a guy. You can't get around this stuff. It happens everyday!

    TBH, Law or not, You can still say whatever you like. The only thing a company can say is your not rehireable, you can make any excuse you can come up with as to why. There is no section or way to put that on your DAC, tho they may put Not Rehireable / Terminated. There is no way for a company to find out about it unless you spill the beans or someone breaks the law and discuses it with the said company.

    Again, if you want to follow the Law to a T then yes you have to report. But show me one person that really gives a flying fip what the law says on this matter and who has ever been taken to court over it. No one, if anything the company will just say no and move on or tell you to pack your bags, worse case scenario.

    So just to clarify. Do 'service failures' appear on your DAC or not?

    You know I have heard both that they do, and also that they do not. So, I don't know.

    I agree that service failures are the big stick that they threaten a driver with. If they don't appear on the DAC like they make drivers believe; that stick is much smaller. So anybody have any clarification with a DAC report in hand?

    Service failures are usually because you are late. In the last three years I've had one, a local delivery in LA I should've turned down. Have I been later than the requested delivery time other than that? Absolutely. The key is to communicate EARLY when you know you will be late.

    There's other ways to get service failures. Speeding in a customer's yard, failure to have steel toed boots and other personal safety gear, using the customer yard as a latrine, or being unprofessional and abusive to the customer or other drivers.

    Be a professional. Communicate so the customer knows when to expect you. Follow directions at the customer. Keep the attitude in check.
