As long as he takes a break it's fine unless hes already under the load then line 5 isn't allowed. It doesn't matter which direction he's heading as long as he takes a break before he heads to the next load.
According to DOT we could use line 5 while under dispatch as long as we drop the trailer and are using the truck as a PC and not advancing the load. We have to be relieved of all responsibilities relating to work. It has to be for a personal reason such as eating or shopping but not maintenance and once you've driven on line 5 if you drive on line 3 the total hours of line 5 and 3 can not exceed 11 total driving.
However if you drive line 3 then line 5 it home you can't exceed 14 total hours.
But line 5 can and does count as off duty so if you were to drive 3 hours on line 3 then 10 hours on line 5 it would reset your 14.
However SNI doesn't allow us to use line 5 while under dispatch. You can be pre planned but not active under that dispatch.
Changing again, the rules change but we're not told til after.

Most companies won't let their C/O's use line 5 as they pay "all miles". And that really goes for just about everyone. Generally the only time companies let a driver use line 5, even if they own the truck, is if the company does not pay unladen mileage. Such as folks on SNI's Choice Program.
When I owned my truck, both the companies I was with didn't allow line 5 driving at all. -
