The way my CPA explained it is you can't be a IC for someone (1099) and they tell you what to do or supervise you. If he has a boss then he's an employee.

Ok what is there not to understand 50/50 after fuel cost is pretty self explanatory . All I'm asking why should I have to pay half of her expenses with no tax benefits ?????? She should pay 100 % of her Road tax-bobtail insurance - maintaince account - permits and so on

Why don't you have this convo with her. It's obvious that your on a bad deal so either y'all meet in the middle somewhere or take your cdl somewhere else, assuming you have a clean record and some exp
