    I am. I'm sure not all subhaulers have such an agreement, but I know Swift does. (Or did, I assume they still do) A Swift driver pulling Walmart dedicated wanted to hire on at 6821 and couldn't because of the agreement Walmart had with Swift. He had to either quit Swift or stop running Walmart dedicated for a period of time before he was eligible for hire. He did what he had to and now works for Walmart. (but he vocalized his troubles to many) I would bet most of the large companies do. Swift, Schneider, Knight, JB, England, etc.

    Do your homework. It certainly is true. I heard about the drivers troubles every time I hit that dispatch office (for over a year) while he was learning (the hard way) how to make the transition. Then he disappeared for a while. I never received an update from him, but I've recently seen him wearing a Walmart shirt.

    Addendum:

    I know of two Walmart drivers that started out as Swift dedicated and had trouble with some kind of no-compete clause between Swift and Walmart when they decided to go to work for Walmart. One hired on in 2000, and the other around 2010. The agreement came as a surprise to both drivers when they wanted to hire on with Walmart. They couldn't just quit Swift and immediately hire on with Walmart. A certain amount of time had to pass.

    The purpose of the agreement: Imagine you are Swift. You send hundreds of drivers over to Walmart to help with their loads. Walmart gets to evaluate these drivers without even hiring them. If they like the driver they hire him and take him away from you. If they don't... well they let you keep the POS. The no compete clause prevents this. It's common in many different types of businesses.

    It's possible that laws have changed (changing the enforceability of such agreements) since then. It's possible the contracts have changed. Walmart and Swift do not update us on their agreements with each other. It's possible my information doesn't apply in todays world, and it's possible, if it still does, the existence of one little detail could made the difference of whether or not such an agreement applied to a specific driver.

    The OP was contemplating possible ways to work into an OTR position with Walmart Transportation. He asked if some of the things he was thinking of made sense. I answered this question and included a warning about another route others have taken that resulted in complications. This gives him something to think about and investigate for himself. It would be better for him to investigate and find that my info is dated than it would be for him to make the same mistake others have made, and have to deal with the complications and delays they had to deal with.
