Remember that your name can be used in other states by someone else. Unless you trademark it or register it.

 

Nope, I have a name registered because my last company had a name that was used by people in two different states. My lawyer had to write to them and ask if they operate in this state, which neither of them did, one in California and the other in Texas. I also worked for a company who incorporated under their name, then a year later was sued by a Canadian company who was incorporated in Canada three days before my company. So it was arbitrated settlement which stated that the Canadian company will never enter the US and my company will never enter Canada, plus my company will pay to lease the name.

I also would not go the llc route for an owner operator, there is no personal asset protection.

 

Express is a holdover from olden times. It means we take your freight straight from shipper to receiver, no collecting, sorting & distributing before it "heads your way."

 

In my case, if the company name used my last name and described the business precisely -- I did not need to wait an extra 3+ weeks to advertise & register a fictitious business name.

E.G. Smith Trucking is good and you could probably get away with Smith Transport, but not Smith Express or Smith Enterprises
