Swift has driver arrested.

CMV Law says you must not be in control of a CMV while drinking or otherwise intoxicated. Parked, truck running, sleeping or not, you are ultimately in control of your CMV. It's just the way it is.

 

I like a cold beer as much as anyone (not 8, though!!). However, I never touch the stuff if I'm anywhere near my truck. It's just not worth the risk.

Actually, with all the hoopla about it, I'm amazed truck stops are still allowed to sell beer (at least in some states).

 

It's because they are 'travel plazas' and they aim to serve the general public as well anymore. They like to make sure those vacationers, hunters, and fishermen can get the beer they want.

 

He had it coming. This is the guy that was "cutting it up" on the cb while drinking 8 beers ... i.e. probably being an obnoxious ###h0le. So, someone got sick of it and called him on it. Last time I checked, if you have an OPEN CONTAINER in ANY vehicle it's (4-wheeler or big truck) it's illegal.

Personally, if there was some jerk doing the same thing in a truck stop while I was there ... I might CONSIDER doing the same thing. If a CDL is how you put food on your family's table, you owe it to yourself to behave in a more responsible manner. If he was on his 34, he could've gotten a hotel ... if he was on his 10 ... then it doesn't matter, he shouldn't have touched the stuff anyway.

 

Company policy and the law is no alcohol in the truck of a commercial vehicle. So if the driver is willing to bend the rules now, how about when he gets that really good load and decides to start off early for it. You cant reprimand for that type of violation. Attorneys would love that. Swift we see that you were aware that the driver doesnt care about your company policy, or the law, and you talked to him. Unfortunately he killed a family which could have been prevented if you followed the law also.

THEY DID THAT JUST TO COVER THEIR ##*ES LEGALLY. I SAW AN OWNER OP LAYED OVER DRINKING A BEER AT THE TS, HE WAS WORRIED I WOULD "RAT" HIM OUT. I SAW HIM GO TO THE BACK AND STAYED THERE ALL NIGHT, KEEP YOUR NOSES IN YOUR OWN ####, UNLESS IT'S EVIDENT THERE IS A DANGER PRESENT.

It was verry dumb for the swift driver or any other to drink while they are responsible for the truck,trailer and possibly the load. I think he got what was comming to him.

It was not a bs complaint your friend had the keys in his possession for his truck.
Key's in a person's possession for the vehicle that they are in and person drinking that is all most states need for the dui charge.
I am sure he knew it was aginst the law to have liquor in his truck but he decided that he was above the law and started drinking beer in the truck in my oppinion he got what he deserved.

That may keep you from a dui but they may still get you for liquor in the truck as it is still in your body.
There are many loopholes that the cops may use to their advantage.

Also if your company has rules against liquor in the truck and they find out even if you own the truck your contract can be terminated and they can DAC you for drinking on the job in a CMV.

In my oppinion you would be better off not answering the door if you have been drinking. Just make sure they can not see you, hear you, or move arround in the truck

 

How could Swift just fire him? All they had to go on was a tip from someone, that's not enough to fire someone. By calling the Highway Patrol, it puts it into their hands. They can determine if he was drinking or if it was just some random, untrue tip.

 

You really wanted him to drive back to the terminal after eight beers? I hope you weren't serious...

And Qualcomm would be pretty much useless -- it do no more than create a "he said, she said" argument.
