Carrying firearms in a truck

    I started a post on a popular website for law enforcement. asking about CMV and firearms since there is so many rumors and no real facts. Figure why not get it from the ones who whould know best. this is what I posted.


    Firearms in CMV
    I am looking to get my CDL and start driving soon OTR threwout the US, But I am having trouble finding any laws for or against it, any help would be greatly appreacated.

    So far 18 have looked at my post with No responces, ill keep ya posted:biggrin_255:

    Emt's in Illinois are not allowed to carry. There are rules concerning this by the hospitals that have authority over the ems district.

    Ok I have receiced 2 answers on the cop only forum.

    thats hard to say because so many states have different laws,not sure but i think consealed carry laws only apply to you state, here your vehicle is an extention of your home so you can carry... but like i said thats here good luck

    There's nothing in the FMCSA that prohibits carrying a firearm in a vehicle. It depends on the state laws where you haul. Additionally, many commercial hauling companies prohibit their drivers from carrying so whether it is legal or not is not an issue but is company policy.

    Ok from both of them pretty much the same answer, For what I read in the small print is that our Companies have been taking away our rights with Lies to "BLAME THE FEDS CRAP".

    From the research i've done it is the best bet to have a good o' pump action shotgun ''less restrictions'', just keep it in the truck and unloaded locking up the ammo will help with local police and a gun case with a lock will be nice. When you are about ready for that sleep time put it in its ready position. From what I have read most issues are at nite.

    Few Info bits:

    Forty-four states have a provision in their State Constitutions similar to the second amendant of the Bill of Rights (the exceptions are California, Iowa, Maryland, Minnesota, New Jersey, and New York).


    U.S. Capitol. TITLE 18 > PART I > CHAPTER 44 ... Title 18
    Notwithstanding any other provision of any law or any rule or regulation of a State or any political subdivision thereof, any person who is not otherwise prohibited by this chapter from transporting, shipping, or receiving a firearm shall be entitled to transport a firearm for any lawful purpose from any place where he may lawfully possess and carry such firearm to any other place where he may lawfully possess and carry such firearm if, during such transportation the firearm is unloaded, and neither the firearm nor any ammunition being transported is readily accessible or is directly accessible from the passenger compartment of such transporting vehicle: Provided, That in the case of a vehicle without a compartment separate from the driver's compartment the firearm or ammunition shall be contained in a locked container other than the glove compartment or console.

    OK so a final recap- yes you can carry a Gun in your Truck just keep it unloaded and locked up so the local Police don't cry.

    Most state laws let you transport them locked up, just be carefull and not have a mag more than 10 rounds in CA.

    Stay away from schools, Gov centers and anywhere else you can't have it.

    Safest bet is a simple pump shotgun, most state laws are only enforced on handguns. And Don't put on the pistal grip and short barrel.

    And what every you do stay out of places like Washington, DC. and a few city's in CA where they don't respect gun rights even thou you are legal.

    And DO Not pull it unless you are in FEAR OF YOUR LIFE plain and simple.

    They have the Federal Right to carry in public where guns are not posted as prohibited. That is what the law states. If a company wants to impede on a Federal Right that is their choice.

    They have the same restriction that most drivers do. Their employer and the doctor whose license is at risk and the district have rules that prohibit it.

    Therefore, as you stated, they supercede the law.

    When hired on, that paper called a contract that you sign
    Can and will restrict personal rights while working
    Rule of thumb if you don't like whats in the contract don't work for the company
    This is allowed via Federal law

    Oh yeah the MA Deuce mounted on top of the cab with remote firing would be perfect. Or how about the MK19? If you're going to take out a truck that cut you off you might as well go all the way and blow it right off the road.
