@chralb already called since no ones here and wanted to verify since none of the names or addresses match for consignee and warehouse and unable to find any associations on the interwebs. And since several warehouses and businesses share the same address i could totally deliver to right address but wrong person!

Question 26: If a driver is permitted to use a Commercial Motor Vehicle (CMV) for personal reasons, how must the driving time be recorded?
Guidance:
a driver is relieved from work and all responsibility for performing work, time spent traveling from a driver’s home to his/her terminal (normal work reporting location), or from a driver’s terminal to his/her home, may be considered off-duty time. Similarly, time spent traveling short distances from a driver’s en route lodgings (such as en route terminals or motels) to restaurants in the vicinity of such lodgings may be considered off-duty time. The type of conveyance used from the terminal to the driver’s home, from the driver’s home to the terminal, or to restaurants in the vicinity of en route lodgings would not alter the situation unless the vehicle is laden. A driver may not operate a laden CMV as a personal conveyance. The driver who uses a motor carrier’s Commercial Motor Vehicle (CMV) for transportation home, and is subsequently called by the employing carrier and is then dispatched from home, would be on-duty from the time the driver leaves home.
A driver placed out of service for exceeding the requirements of the hours of service regulations may not drive a Commercial Motor Vehicle (CMV) to any location to obtain rest.

You'll note it makes no mention of a trailer or not and is rather vague on "short distance" but clear on "going home". Under the "interpretations" section to 395, "laden" refers to freight. I don't see any difference between BT and pulling an empty box... both are company equipment and the Driver is neither under load nor being compensated for their time.
But I've been wrong before...

Thanks for posting this information.
Now the downside of driving home without a load or order is not being paid for those miles... but sometimes getting home and on time is more important than waiting around to be dispatched there. -
For example, You're under dispatch and you've just finished your day and went off duty or in sleeper. You need to hit Wal-Mart to buy food or something. You can use the PC to do so as long as it doesn't exceed the 45 minutes driving allowed. -

Regardless, the Alan I spoke to did admit that my residence location is a detriment to me getting home time. He also was taken aback when he learned I had turned in my notice.
I don't know. I have my alternate plans that in no way effect future home time. And, sadly, Abilene is not part of those plans.RebelChick Thanks this. -
