DAC report. is it true?

    Hireright is just a depository for information. Most of the larger carriers use it. However from what I am beginning to see is carriers are actually contacting the applicant's old employers to verify the information on an application. I think at some point hireright will get the safeguards in place to stop these lawsuits. The FMCSA rules are getting tighter and tighter and the regulations are getting more and more detailed in how a company hires a driver. The FMCSA mandates a carrier build and maintain a driver file and review it once a year. I know about more then one driver fired because of that yearly review. I was reading in facebook just last night about a driver recently fired because her CDL was suspended and the suspension was not reported and not seen till her MVR was pulled during her yearly review. The main reason this story was on facebook was the carrier could not allow her to drive. They made her go to a truck stop and sit. They did not tell her that a driver was being flown out to where she was. She was give a bus ticket home and made to clean out her truck right on the spot. Hireright makes all these tasks mandated by the FMCSA easier. Hireright is not going anywhere either. While it may not be politically correct in these boards a carrier has the right to know. They have the right to know if you have a history of abandoning a truck or load. They have the right to know if you have a lead foot. They have the right to know that you have a history of quitting 4 times over the last 18 months. They have the right to know if you have a history of hitting fixed objects and they have the right to know if you have a history of being rude to customers. My largest complaint against hireright is a driver should be allowed to place along with a negative report their side of it. The dirty little secret to all of this is most carriers knows if another carrier has a history of backstabbing in hireright and ignores the information. In 2012 I was sitting with a friend of mine that works in the Crete safety dept. This person was looking at the DAC report of an applicant that contained negative information. I asked will you hire? The answer was yes we will because that carrier has a history of doing this. Otherwise the DAC was clean. DAC is not going away. However everyday that goes by DAC loses some importance because carriers use other resources to make hiring decisions.

    The problem with Hirerite is the lack of oversight, companies can post retaliatory information and there is nothing a driver can do except dispute it. Their information is suspect to say the least. A lot of companies are getting away from DAC just for that reason.

    Hireright don't have the manpower to approve every entry in it's database. Remember hireright is used by more then just trucking companies. I agree that bad information gets entered, but I do not believe it is that prevalent. Like I said in my post some carriers ignore things from other carriers because they see a history of this if the DAC report is otherwise clean. However you are mistaken about carriers getting away from DAC. In fact hireright is actually gaining customers from the trucking industry because of the FMCSA and the regulations their working under. Another thing about hireright. There are many smaller carriers and local companies that order ad hoc DAC reports. They are more expensive per, but sometimes are needed because a carrier needs it to satisfy the FMCSA in regard to that driver qualification file ALL carriers and companies that use CDL drivers are MANDATED to build, keep and review yearly.

    You DO have a right to submit a statement and to challenge any entry in your DAC report. DAC.Hireright is covered by the same laws a credit bureaus.

    I did not make my point right, that is my bad. My point was negative information submitted to DAC should always generate a letter to the driver with the information on it to dispute. The company should always report your address to hireright and you fill out the form if you feel the information is not accurate. This would always be part of the record. This way you don't have to do anything but fill out a form. The way it is now you have to be proactive with information in some cases that might be old.

    Edited to add this is something like credit card companies have to do now if you get denied. They have to supply you the information used to make the decision.
