I'm a company driver for a flatbed company. I'm paid percentage of the load. I hauled a load from SC to ME. The customer in ME refused the product due to the quality, calling it defective. I had to haul it back to SC. Instead of a paycheck, I got a letter saying I didn't get paid because they didn't get paid! Is this legal? Shouldn't my boss have to pay me regardless? Shouldn't the customer have to pay my company? Never had this happen before.

Your a company driver? Far as I know, you did a job not once but twice, they should be paying you. I'd be calling your state labor board if you can't get this resolved

Call state labor board as quick as possible, then take truck and turn it in and tell them stick it where sun don't shine....if you did everything required for load, tarping...etc. then it wasn't refused on your part...but I wouldn't let them screw me around like that

That's what I was thinking. Maybe taking them to court if they don't pay up.

I parked the truck and quit as soon as I got back our yard in SC. The dispute is between the 2 customers, nothing to do with me. I properly secured it with straps, edge protectors and tarps. Even the forklift operator at the shipper thought the insulation looked "off".

March yourself down to the courthouse and file a warrant for the owner of the trucking company. What you are doing is dragging him into Small Claims Court. Most probably, the minute the warrant is served on him, you will get paid.

I think you have a serious case for litigation.
I was stiffed on my last paycheck with a previous employer. When I contacted an attorney his exact words were "you had a reasonable expectation to be paid on a set day, and if your pay was not deposited on that day after completing a job, then that employer is in breach of The contract"Opus Thanks this. -
