Please note, I am not being mean or picking on you, just pointing out facts. I am a small fleet owner and a DOT regulatory compliance consultant, so I specialize in knowing these rules inside and out. Given what you have stated, and assuming you are telling the truth you still are in a bind with no easy, or cheap way out. A typical SAP will cost you several thousand dollars, up front.
Now that the allotted time frame for a split specimen test has passed there is nothing you can do to return to commercial driving without taking and completing a SAP. Not challenging the false positive is the same as admitting it was accurate in the eyes of the regulations. Your professional driving career is pretty much over, the only places that will now hire you will be bottom feeders, and again only after you have completed the substance abuse program, and agree to submit to extra drug tests which are direct observation tests and very invasive/embarrassing.
I am not picking on you, OP, but so many folks wait too long after a problem such as a failed drug test or traffic citation before seeking legal advice. This won't help you, but maybe someone else THIS IS YOUR CAREER, YOU CAN NOT AFFORD TO NOT HAVE THE SPLIT SAMPLE TESTED!!!!!! I don't care if you had to go without dinner for a day or two, this was the most important thing at that moment in time. Besides, if it was an error you would not have been obligated to pay for the retest. The regulations make no determination who must pay, other then that the employer must pay for the test upfront and seek reimbursement from the employee later.

If you don't have a prescription for amoxicillin or for cocaine, I've got some bad news for you... you did coke. That's the only known substance that will make you test positive for cocaine, other than cocaine.
Flushed a potentially great career down the ####ter for a substance that isn't even fun or in any way beneficial. Trust me, I've done the research. -

You never worked for that company so you dont have to list them as a previous employer which means you dont have to disclose a failed test. Just move on to the next company. When you get to that part on the application where it asks if you've ever failed a drug test your answer is "no".
