No doubt and because he did a good deed western will probably ruin his career for years to come.Yes western had every right to fire this driver they may have even lost a valued customer but I don't think they should tarnish him in a bad way and who knows maybe they didn't.

If one of my drivers did something like this he would be fired, arrested and I would PERSONALLY make sure he couldn't even get a job at Burger King.

A better idea is maybe you pay for it and "let that one go" Really!?!? Guy should have been canned imedeatly.
Following your logic every driver should be able to give away someone's load if he thinks he's doing right thing. If that's the case I'm gonna follow around the armored car.

Imagine for a moment that Tim was an armored car guard. As an armored car guard , Tim sees people need money to buy the plywood. Tim decides to open truck and hand the money out to these poor souls for plywood. I bet, most would not be praising driver Tim, now inmate Tim.

Good luck with that. As I stated before, the alleged crime would be prosecuted in the jurisdiction which it occurred. That means the county where it occurred. That means that it is HIGHLY likely that a few folks who either benefitted directly or knew someone who benefitted from the plywood given away will be sitting on that jury. It is also pretty much guaranteed to be made up nearly entirely of folks sympathetic to the needs of the people helped. In other words, the likelihood of a conviction in the matter is almost zilch. Combine that with the fact that the DA will be up for re-election soon and prosecuting this case would be EXTREMELY detrimental to his bid for another term and you can press charges all you want because NOTHING will be done about it. Hell, even the cops would likely tell you to go jump off a bridge for insisting upon that guy's arrest knowing the conditions under which it occurred AND the nearly 100% chance the DA will say "no way in hell am I prosecuting this case".

Then, you'd have a ton of bad press to manage, getting the reputation as a scrooge (to put it nicely). How low would your rates have to go to overcome people's unwillingness to do business with such a cold & heartless SOB that fired and tried to have a driver arrested merely for helping people prepare for an approaching disaster? Knowing full well the receiver wouldn't reopen until AFTER the storm had passed? Expecting that driver to sit in his truck through a hurricane waiting for the store to reopen instead of offloading and evacuating?

This wasn't your typical "I'm late. They're closed. Gotta wait til morning" situation. As such, the rules are a little different.

Problem I see here is, Tim has a big heart. What if Tim were to get hired on with another company, he is driving reefer. One day Tim has a flat tire in middle of nowhere Texas. While waiting 50 or more starving immigrants come up on Tim. given his history I imagine big hearted Tim will open trailer and share the food. Maybe it is best Tim not be responsible for the goods of others.

I think Tim learned his lesson and unlikely if Tim ever ran into more needy folks unlikely those needy folks would even know or heard of the good natured person Tim is.

It still wasn't his to just give away. Wasn't his call to make. I haul reefer and I don't open the doors for every hungry homeless person I see.

Point I am trying to get across is, the man can not be trusted any longer, though his deed was done with good intentions.
