Fines for owner operators by the companies for violations

    I run a small trucking company with only 4 trucks (so far), they are all owner operated. One of the owners had a warning for speeding that he didn't report. No harm done (if I understand the portal.fmcsa well) but I want to prevent not reporting check ups and violations. How do the companies "punish" irresponsible owners? Please give some advice. Thank you!

    You inform the O/O of the company policy and procedures to be followed in the future, for situations such as this.You outline what is expected, what should be done, and what the consequences will be, for failure to improve. You put it in writing, you sign it, he signs it, gets a copy and you put your copy in his file. If it happens again, you suspend him. Third time...Terminate the lease.

    No I haven't. I understand that I'll have to put it in writing and have it signed by them. How do you determine fines?

    Are you sure about that? I know few companies that are fining the owners for violations and points on safer. You think that is illegal?

    I doubt it. First of all - they were not told that this is company policy. Secondly if you're suspending an o/o for a violation of safety rules, you're already financilally penalizing him, by not allowing him to work. You may want consult an attorney experienced in these matters before you proceed with "fines" for safety violations. Thats a good way to run off a O/O

    You shouldn't feel offended from any reason. I do understand that I cannot fine them if the rules were not set up at the beginning. I'm planing to introduce company policy related to violations. I cannot let o/o doing what ever they want because I'll go bankrupt if the insurance gets too high and the brokers won't give me loads. I'm trying to be fair, not the judge.

    Thanks for the comment Eddiec. I do understand I cannot penalize them now but I'm planing to introduce policy that will prevent them of having violations without consequences. Not trying to be a bad guy but if the violations keep coming my insurance policy will go too high and the brokers won't give me any loads. Now trying to figure out what is fair punishment.
