Texas log book laws

    I was talking to another Texas driver the other day who only runs in Texas, he told me that the 30 minute rule is not required in Texas and that if I'm off duty for 2 hours it does not count against my total on duty/driving time. Is this true? I've been running my logs like I've always run them which means i always put 30 minutes down for a break before 8 hours is up and I count all hours from the start of the day to the end so if im at a receiver/shipper for a couple hours I count that as on duty not driving time but would be nice not to have to count everything in the particular situations. Oh and the other thing he said was that in Texas 8 hours is all that is required to restart not the 10. just wanting to make certain that this is actually the case before committing it to my log. and yes I've read the texas code book and it seems that this is the case but with the lawyer jargon it's hard to be 100% certain.

    I'll not get in the specifics of times in Texas, but..

    The only way this applies is if the load is 100% intrastate. It does not matter if you ever cross state lines (or country lines) or not, but if the load does you must follow normal fmcsa logging rules.

    If you are an O/O leased to a company or a company driver you should check with your log people.

    Right. But the reality in my situation is that I'd probably know more about it then they would as I work for a small company and there not exactly experts in Texas law concerning log book requirements. But I'll call them anyways.

    One can drive 12 and wrk 15 on the TX log rules for oil field. Also it's a 24 hr restart on your 70 and a no 30 min breaks. But this is for oil field use only.

    I'm sure some new oil field guys in Texas will be helped by that.

    Are you saying that what you stated as rules for oil field drivers has no application for other drivers in Texas? so in another words 30 min breaks are still required and 11/14 and so on in Texas? or are you just familiar with oil field rules? just to clarify.

    From Tx DPS:
    GENERAL RULE - All Carriers - Intrastate In Texas (37 TAC 4.12)
    12 Hour Rule (37 TAC 4.12(a)(2)) Drivers are allowed to drive for 12 hours following 8 consecutive hours off duty.
    15 Hour Rule (37 TAC 4.12(a)(2)) A motor carrier cannot permit or require a driver to drive after 15 hours are spent on duty following 8 consecutive hours off-duty.
    NOTE: Drivers in intrastate commerce violating the 12 or 15 hour limits shall be placed out-of-service for eight consecutive hours.
    70 Hour Rule (37 TAC 4.12(b)(2)) A motor carrier must not permit or require a driver to drive after having been on duty ‰ 70 total duty hours in seven days ‰
    A driver may restart a 7 consecutive day period after taking 34 or more consecutive hours off-duty

    Ok, seems simple enough. Now I just need to find out if the 30 minute breaks are required.

    Not totally sure if it's intrastate rules or oil field rule. But in 2013 it was explained to me that it was an oil field rule

    30 min break ist required on oil field for sure. Now does that apply to intrastate regular hos. I can't say.
